In oral arguments for an appeal hearing, Sony Music appeared to admit that the Jackson songs were actually performed by Malachi. But now Sony is saying that they never admitted the songs were not by Jackson himself, and other lawyers involved in the case have said any statements were just speculative and part of the appeal process. Malachi, meanwhile, has an active career and is helping his daughter launch her own musical career.<\/p>\n\n\n\n<p>Here is what you need to know about Jason Malachi and what happened.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-1-sony-representatives-say-they-never-conceded-the-songs-were-not-by-michael-jackson\">1. Sony Representatives Say They Never Conceded the Songs Were Not by Michael Jackson<\/h4>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe class=\"desktop mobile\" src=\"https:\/\/www.youtube.com\/embed\/U9bR8h78NSI\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Multiple news sources reported on August 23 that in appeal court proceedings, Sony appeared to admit that three Michael Jackson songs released in Michael Jackson\u2019s first posthumous album in 2010, called Michael, were actually sung by Jason Malachi. The songs are \u201cBreaking News,\u201d \u201cKeep Your Head Up,\u201d and \u201cMonster,\u201d&nbsp;<a href=\"https:\/\/edm.com\/news\/sony-admits-to-publishing-fake-michael-jackson-songs\" target=\"_blank\" rel=\"noreferrer noopener\">EDM reported<\/a>. The album debuted at number 3 and was released by Sony Music Entertainment and Epic Records. One of the contested songs is above.<\/p>\n\n\n\n<p>However, Sony Music said in an statement on August 24 that they&nbsp;<em>never&nbsp;<\/em>conceded the songs were fake,&nbsp;<a href=\"https:\/\/variety.com\/2018\/biz\/news\/sony-music-has-not-conceded-that-vocals-on-michael-jackson-album-are-fake-1202916324\/\" target=\"_blank\" rel=\"noreferrer noopener\">Variety reported<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan Freedman<\/a>, who represents other defendants in the case, explained to Variety that when arguing a motion on appeal, you make the arguments with the assumption that everything in the complaint is true. This isn\u2019t an actual concession that the assumptions&nbsp;<em>are&nbsp;<\/em>true, however, but a method for that particular stage in the trial.<\/p>\n\n\n\n<p>\u201cWhen you review the motion on appeal, you assume that everything in the complaint is true. Any admission that was made was for purposes of that argument only.\u201d<\/p>\n\n\n\n<p>Sources told Variety that people who attended the hearing on Tuesday were relying on a statement by an attorney for Jackson\u2019s estate, who said something about what would happen \u201ceven if the vocals weren\u2019t Jackson.\u201d They said the attorney\u2019s comment was speculative, not an admission.<\/p>\n\n\n\n<p>Zia Modabber of Katten Muchin Rosenman LLP, representing Sony and the Jackson estate, said: \u201cNo one has conceded that Michael Jackson did not sing on the songs. The hearing&nbsp;Tuesday&nbsp;was about whether the First Amendment protects Sony Music and the Estate and there has been no ruling on the issue of whose voice is on the recordings.\u201d<\/p>\n\n\n\n<p>Here are the two other disputed songs:<\/p>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe class=\"desktop mobile\" src=\"https:\/\/www.youtube.com\/embed\/U33Q0reRQMM\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe class=\"desktop mobile\" src=\"https:\/\/www.youtube.com\/embed\/RNqAIpfqZdw\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>From the beginning, there were questions about the authenticity of the songs,&nbsp;<a rel=\"noreferrer noopener\" href=\"http:\/\/www.vulture.com\/2018\/08\/michael-jackson-songs-were-actually-fake-sony-admits.html\" target=\"_blank\">Vulture reported<\/a>. Fan Vera Serova brought a class action lawsuit against Eddie Cascio (a friend of Jackson\u2019s), Angelikson Productions LLC, and James Porte, songwriter, to get at the truth. Cascio and Porte said the songs were recorded in 2007, but had no evidence to back up those claims. Forensic audiologist Dr. George Papcun studied the songs and in a 41-page report said they were not Jackson\u2019s, EDM reported.<\/p>\n\n\n\n<p>In 2016, Sony said they took Cascio and Porte\u2019s word that the songs were authentic without investigating on their own, EDM reported. But in a statement in 2010, Sony said: \u201cWe have complete confidence in the results of our extensive research as well as the accounts of those who were in the studio with Michael that the vocals on the new album are his own.\u201d<\/p>\n\n\n\n<p>So the actual authenticity of the songs is still not known.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-2-malachi-fooled-people-into-believing-one-of-his-songs-was-michael-jackson-s-in-2007-in-2011-someone-posted-on-his-facebook-that-he-was-on-the-posthumous-album-but-he-later-said-he-was-hacked\">2. In 2011, Someone Posted on His Facebook that He Was on the Posthumous Album, But He Later Said He Was Hacked<\/h4>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe class=\"desktop mobile\" src=\"https:\/\/www.youtube.com\/embed\/g1jgOwtNqT8\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>In September 2007, Jason Malachi released a song called Mamacita (listen to it above) that fooled many people, including a Pittsburgh radio station, into believing it was a song by Michael Jackson,&nbsp;<a href=\"http:\/\/www.tmz.com\/2007\/09\/21\/new-jacko-tracko-done-by-a-white-guy\/2\/\" target=\"_blank\" rel=\"noreferrer noopener\">TMZ reported<\/a>. TMZ at the time said he sounded exactly like Michael Jackson.<\/p>\n\n\n\n<p>Then in 2011,&nbsp;<a href=\"http:\/\/www.tmz.com\/2011\/01\/16\/michael-jackson-album-breaking-news-jason-malachi\/\" target=\"_blank\" rel=\"noreferrer noopener\">TMZ reported<\/a>&nbsp;that Malachi shared on Facebook that he was the singer behind Breaking News, Keep Your Head Up, Monster, and Stay \u2014 songs on Jackson\u2019s posthumous album. A post on his Facebook page read: \u201cSheesh guys, I guess it\u2019s time to confess. I\u2019ve lied to many people, including someone today, but\u2026. It was me. It was me who sang Breaking News, Keep Your Head Up, Monster and Stay.&nbsp;I had a agreement with the record company, but now the cat is out of the bag. Sorry to all my fans, and fellow Michael Jackson fans.\u201d (The post is no longer published.)<\/p>\n\n\n\n<p>But later that day, Malachi returned to Facebook and said his Facebook account had been hacked and he hadn\u2019t written the post,&nbsp;<a href=\"https:\/\/www.spin.com\/2012\/02\/new-fuel-michael-jackson-posthumous-album-controversy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Spin noted<\/a>.&nbsp;Malachi\u2019s manager also denied in 2011 that Malachi sang any of those songs,&nbsp;<a href=\"https:\/\/variety.com\/2018\/biz\/news\/sony-music-has-not-conceded-that-vocals-on-michael-jackson-album-are-fake-1202916324\/\" target=\"_blank\" rel=\"noreferrer noopener\">Variety reported<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-3-malachi-released-his-first-album-in-2003-has-said-michael-jackson-was-his-greatest-musical-influence\">3. Malachi Released His First Album in 2003, &amp; Has Said Michael Jackson Was His Greatest Musical Influence<\/h4>\n\n\n\n<p>Malachi is well known for his 2010 album Critical, which many have said sounds very similar to Michael Jackson,&nbsp;<a href=\"https:\/\/www.last.fm\/music\/Jason+Malachi\/+wiki\" target=\"_blank\" rel=\"noreferrer noopener\">Last.Fm reported<\/a>. You can listen to his tracks from Critical on Myspace&nbsp;<a href=\"https:\/\/myspace.com\/jasonmalachi\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>. The one above is called Let Me Go. Songs on his album Critical include Room 2 Breathe, Everything to Me, How I Do, Runner Up, and more. He has 11 songs on the album.
