{"id":5395,"date":"2019-05-03T17:53:16","date_gmt":"2019-05-04T00:53:16","guid":{"rendered":"https:\/\/ftllp.net\/?p=5395"},"modified":"2024-11-02T15:37:50","modified_gmt":"2024-11-02T22:37:50","slug":"hbo-and-jackson-estate-continue-legal-dispute-over-leaving-neverland","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/hbo-and-jackson-estate-continue-legal-dispute-over-leaving-neverland\/","title":{"rendered":"HBO And Jackson Estate Continue Legal Dispute Over \u2018Leaving Neverland\u2019"},"content":{"rendered":"\n<p>LOS ANGELES (CelebrityAccess) HBO and the legal team behind the Michael Jackson Estate continue to battle it out in court regarding the controversial documentary \u201cLeaving Neverland,\u201d with HBO holding now bars in the most recent filing.<\/p>\n\n\n\n<p>HBO recently attempted to shut down a shift to arbitration with Jackson\u2019s attorneys regarding the $100 million lawsuit, stating, \u201cOptimum Productions and John Branca and John McClain, in their capacities as co-executors of the Estate of Michael Jackson, ask this Court to order arbitration of a poorly disguised and legally barred posthumous defamation claim against Home Box Office, Inc. that arises from HBO\u2019s exercise of its First Amendment rights to exhibit an expressive work on an issue of public concern\u2014the documentary<em>&nbsp;Leaving Neverland<\/em>,\u201d according to Deadline Hollywood.<\/p>\n\n\n\n<p>HBO\u2019s attorneys, Daniel Petrocelli and Theodore Boutrous, added, \u201cPetitioners\u2019 purported basis for their claims is a single non-disparagement sentence buried in a confidentiality rider to a more than 26-year-old expired and entirely unrelated contract,\u201d and added, \u201cPetitioners do not, and cannot, allege that any information HBO obtained during the course of performing the 1992 Agreement, let alone any confidential information or trade secrets, was provided to the filmmakers.\u201d<\/p>\n\n\n\n<p>Attorneys for Jackson fired back with the following:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cHBO\u2019s opposition clearly shows that they are afraid to have this matter adjudicated. The Jackson Estate wants an arbitration open to the public for all to see. If HBO thinks the contract does not apply or is expired then why are they opposing adjudicating it?&#8221;<\/p>\n<cite><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan Freedman<\/a> told Deadline.<\/cite><\/blockquote>\n\n\n\n<p>\u201cThe reason why is because they know they were complicit in this one-sided farce of a money grab that clearly violates the agreement,\u201d&nbsp; Freedman added. \u201cNow they are trying to delay the inevitable beating that they will suffer when this matter is adjudicated.
