The estate has&nbsp;<a href=\"https:\/\/www.vanityfair.com\/hollywood\/2019\/02\/leaving-neverland-michael-jackson-family-cbs-this-morning?verso=true\">repeatedly<\/a>&nbsp;slammed both the doc and Jackson\u2019s accusers, claiming that their allegations that the late singer sexually abused children are financially motivated. In February, the estate&nbsp;<a href=\"https:\/\/www.vanityfair.com\/hollywood\/2019\/02\/michael-jackson-estate-sues-hbo-leaving-neverland?verso=true\">sued<\/a>&nbsp;HBO over the doc, citing an alleged non-disparagement clause from 1992. (Since Jackson is dead, claims of defamation are&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.rollingstone.com\/tv\/tv-news\/michael-jackson-estate-hbo-leaving-neverland-lawsuit-797455\/\" target=\"_blank\">off the table<\/a>.) Now, however, HBO has hit back, as the premium cabler\u2019s lawyers argue that the estate\u2019s interpretation of the clause is a reach.<\/p>\n\n\n\n<p>Per&nbsp;<a href=\"https:\/\/variety.com\/2019\/biz\/news\/michael-jackson-estate-lawsuit-leaving-neverland-hbo-counters-1203204141\/\" rel=\"noreferrer noopener\" target=\"_blank\"><em>Variety<\/em><\/a>, HBO lawyers&nbsp;<strong>Daniel Petrocelli<\/strong>&nbsp;and&nbsp;<strong>Theodore Boutrous<\/strong>argued in a motion, filed Thursday, that the contract the estate cites expired long ago; HBO\u2019s non-disparagement deal came as part of a pact to air footage of a Jackson concert in Bucharest.&nbsp;<em>Variety<\/em>&nbsp;notes that HBO has not aired the film since 1992.<\/p>\n\n\n\n<p>\u201cThe vague and overbroad interpretation of the non-disparagement sentence that Petitioners urge this Court to adopt would, if accepted, violate HBO\u2019s First Amendment right to distribute expressive content on an issue of public concern,\u201d the motion states. Per&nbsp;<em>Variety,<\/em>&nbsp;the lawyers argue that such a wide interpretation of the agreement would also \u201crun afoul of the public policy embodied in numerous California statutes to protect children from sexual abuse,\u201d and \u201clegitimize the creation of a special category of wealthy, powerful, or famous individuals who could\u2014through a lifetime of contracts with news or media companies\u2014preserve for themselves via contract posthumous control over how they are portrayed and described in a way that ordinary citizens cannot.\u201d<\/p>\n\n\n\n<p><em>Leaving Neverland<\/em>&nbsp;is a four-hour expos\u00e9 focused on interviews with&nbsp;<strong>Wade Robson<\/strong>&nbsp;and&nbsp;<strong>James Safechuck,<\/strong>&nbsp;ex-Jackson acolytes who claim Jackson sexually abused them when they were children. (Jackson consistently denied allegations of pedophilia when he was alive, and was&nbsp;<a href=\"https:\/\/www.nytimes.com\/2005\/06\/13\/national\/michael-jackson-is-acquitted-on-all-counts-in-molestation-case.html\" rel=\"noreferrer noopener\" target=\"_blank\">acquitted<\/a>&nbsp;on all counts during his molestation case in 2005.) When the doc first premiered earlier this year, following the Lifetime expos\u00e9&nbsp;<em>Surviving R. Kelly,<\/em>&nbsp;it re-ignited conversations around examining artists\u2019 legacies in the wake of serious accusations of abuse\u2014especially for artists who, until recently, have skirted severe career repercussions. (<strong>R. Kelly<\/strong>has been accused of sexual abuse, as well as holding women in a \u201ccult\u201d-like setting\u2014claims he has repeatedly&nbsp;<a href=\"https:\/\/www.vanityfair.com\/hollywood\/2019\/03\/r-kelly-sexual-abuse-allegations-cbs-this-morning-gayle-king?verso=true\">denied<\/a>, even amid&nbsp;<a href=\"https:\/\/www.vanityfair.com\/style\/2019\/02\/r-kelly-charges-aggravated-sexual-abuse?verso=true\">new charges<\/a>.)<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Jackson estate attorney&nbsp;<strong>Bryan Freedman<\/strong><\/a>&nbsp;has already responded to HBO\u2019s motion, claiming the network is \u201cafraid to have this matter adjudicated because it will expose the falsity of the documentary,\u201d&nbsp;<em>Variety<\/em>reports. The estate\u2019s most recent brief before this response&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/michael-jackson-estate-wants-hbo-meeting-leaving-neverland-will-become-hbos-greatest-shame-10-page-l-1184415\" target=\"_blank\">characterized<\/a>the doc as propaganda.<\/p>\n\n\n\n<p>\u201cThe Jackson Estate wants an arbitration open to the public for all to see,\u201d Freedman added. \u201cIf HBO thinks the contract does not apply or is expired then why are they opposing adjudicating it? The reason why is because they know they were complicit in this one-sided farce of a money grab that clearly violates the agreement. Now they are trying to delay the inevitable beating that they will suffer when this matter is adjudicated. It won\u2019t work. Stay tuned, because at least we are offering them a chance to tell their side of the story, unlike [what] they did in the creation of the one-sided fiction intended to disparage Michael Jackson. Let this be a warning to all talent that HBO will disregard the truth and distribute fictitious one-sided content in violation of the artists\u2019 rights it promised to protect.
