{"id":5363,"date":"2019-03-06T17:27:22","date_gmt":"2019-03-07T01:27:22","guid":{"rendered":"https:\/\/ftllp.net\/?p=5363"},"modified":"2024-11-02T17:16:35","modified_gmt":"2024-11-03T00:16:35","slug":"hbo-calls-the-jackson-estates-100-million-lawsuit-a-publicity-campaign","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/hbo-calls-the-jackson-estates-100-million-lawsuit-a-publicity-campaign\/","title":{"rendered":"HBO Calls the Jackson Estate\u2019s $100 Million Lawsuit a \u2018Publicity Campaign\u2019"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-last-february-the-michael-jackson-estate-made-good-on-its-promise-and-filed-a-100-million-civil-lawsuit-against-hbo\">Last February, the Michael Jackson Estate made good on its promise and filed a $100 million civil lawsuit against HBO.&nbsp;<\/h2>\n\n\n\n<p>The cable network\u2019s decision to air the controversial&nbsp;<em>Leaving Neverland&nbsp;<\/em>documentary had apparently violated a non-disparagement agreement.<\/p>\n\n\n\n<p>In 1992, HBO had agreed to never disparage the singer in exchange for exclusive footage from Jackson\u2019s&nbsp;<em>Dangerous World Tour<\/em>.<\/p>\n\n\n\n<p>The late pop singer\u2019s family claims that Dan Reed\u2019s&nbsp;<em>Leaving Neverland&nbsp;<\/em>is&nbsp;based on false accusations. &nbsp;In fact, both of Jackson\u2019s accusers \u2013 Wade Robson and James Safechuck \u2013 have previously claimed that Jackson had never molested them.<\/p>\n\n\n\n<p>The estate\u2019s lawsuit against HBO eventually shifted to the U.S. District Court for the Central District of California.<\/p>\n\n\n\n<p>Aiming to push the case back to state court, Jackson\u2019s family had asked a California federal judge to send the lawsuit back to arbitration.<\/p>\n\n\n\n<p>Citing the Federal Arbitration Act, the estate had strongly pushed for arbitration,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>Apparently, HBO was happy to rely on the fact that deceased persons cannot sue for defamation, and thus saw no need to comply with any sort of journalistic ethics at all.<\/em><\/p><p>\u201c<em>Unlike HBO, the estate isn\u2019t interested in playing games and wants a real process to expose HBO\u2019s lack of journalistic integrity.<\/em>\u201d<\/p><\/blockquote>\n\n\n\n<p>As noted, the Jackson Estate faces a very serious problem \u2013 under current United States law, a deceased person can\u2019t sue for defamation. &nbsp;Neither can that person\u2019s estate.<\/p>\n\n\n\n<p>Maintaining Jackson\u2019s innocence, his family called the documentary \u201clies.\u201d&nbsp; The petition further slammed Robson and Safechuck as \u201cadmitted perjurers.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>Michael Jackson can never be silenced.&nbsp; His music and artistry live, as does his innocence.<\/em><\/p><p>\u201c<em>They will long outlast false claims, gossip, and allegations spread by those who seek to make money off him.<\/em>\u201d<\/p><\/blockquote>\n\n\n\n<p>Now, HBO has fired back.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-federal-court-works-great-for-hbo-but-not-so-much-for-the-jackson-estate\">Federal court works great for HBO.&nbsp; But not so much for the Jackson Estate.<\/h3>\n\n\n\n<p>Fighting back against the family\u2019s motion to send the lawsuit back to a state court, an HBO spokesperson said a federal court remains the \u201cappropriate place\u201d for the case.<\/p>\n\n\n\n<p>The cable network&nbsp;<a href=\"https:\/\/www.law360.com\/media\/articles\/1156345\/hbo-slams-jackson-estate-s-push-for-neverland-arbitration\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a>&nbsp;a request to arbitrate the breach of contract claims \u201cas poorly conceived as the claims themselves.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>There are no remaining rights to enforce under the expired 1992 agreement.&nbsp; [E]ven if any enforceable rights still exist in that agreement, the claims petitions attempt to make here are not arbitrable, and enforcing the agreement as petitioners seek to do in this situation would violate HBO\u2019s constitutional rights and numerous public policies.<\/em>\u201d<\/p><\/blockquote>\n\n\n\n<p>The network\u2019s lawyers, Daniel M. Petrocelli and Theodore J. Boutrous Jr., added the lawsuit \u201cappears to be part of a transparent effort to bolster their publicity campaign against the documentary.\u201d &nbsp;Both have asked Judge George H. Wu to deny the family\u2019s request for arbitration.<\/p>\n\n\n\n<p>Following the request, the Michael Jackson estate quickly responded.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">The estate\u2019s lawyer, Bryan J. Freedman<\/a>, said in a statement,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>HBO\u2019s opposition clearly shows that they\u2019re afraid to have this matter adjudicated because it will expose the falsity of the documentary<\/em>.\u201d<\/p><\/blockquote>\n\n\n\n<p>According to John Branca, a longtime lawyer for Michael Jackson who now serves as an executor for the estate,&nbsp;<em>Leaving Neverland<\/em>&nbsp;has had a significant financial impact on the estate\u2019s business.<\/p>\n\n\n\n<p>At a Harvard Law School discussion about the family\u2019s decision to take on Dan Reed, Branca admitted,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201c<em>Because the laws of defamation are what they are, there is nothing we can do or say. &nbsp;I\u2019m going to suggest the law should be changed to protect the deceased at least for a period of time.<\/em>\u201d<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Last February, the Michael Jackson Estate made good on its promise and filed a $100 million civil lawsuit against HBO.&nbsp; The cable network\u2019s decision to air the controversial&nbsp;Leaving Neverland&nbsp;documentary had apparently violated a non-disparagement agreement.
