{"id":5321,"date":"2019-05-20T16:48:25","date_gmt":"2019-05-20T23:48:25","guid":{"rendered":"https:\/\/ftllp.net\/?p=5321"},"modified":"2024-11-02T15:24:13","modified_gmt":"2024-11-02T22:24:13","slug":"pro-gamer-tfue-files-lawsuit-against-esports-org-over-grossly-oppressive-contract","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/gaming\/pro-gamer-tfue-files-lawsuit-against-esports-org-over-grossly-oppressive-contract\/","title":{"rendered":"Pro Gamer Tfue files lawsuit against esports org over \u2018grossly oppressive\u2019 contract"},"content":{"rendered":"\n<p><a href=\"https:\/\/www.twitch.tv\/tfue\">Turner \u201cTfue\u201d Tenney<\/a>, one of the world\u2019s premier streamers and esports pros, has filed a&nbsp;<a href=\"https:\/\/www.scribd.com\/document\/410833590\/Tenney-v-Faze-Clan#from_embed\">lawsuit<\/a>&nbsp;against esports organization Faze Clan over a \u201cgrossly oppressive, onerous and one-sided\u201d contract, according to&nbsp;<a href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/tfue-sues-faze-clan-oppressive-contract-1212124?\">THR<\/a>.<\/p>\n\n\n\n<p>The complaint alleges that Faze Clan\u2019s Gamer Agreement relegates up to 80% of the streamer\u2019s earnings from branded content (sponsored videos) to Faze Clan, and that the contract hinders Tfue from pursuing and earning money from sponsorship deals that Faze Clan hasn\u2019t approved.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Tfue\u2019s lawyer, Bryan Freedman of Freedman + Taitelman<\/a>, took the complaint to the California Labor Commissioner with issues that span far beyond financial contracts. Freedman wrote that Faze Clan takes advantage of young artists and actually jeopardizes their health and safety, noting an incident where Tfue was allegedly pressured to skateboard in a video and injured his arm. Freedman also wrote that Faze Clan pressured Tfue to live in one of its homes where he was given alcohol before being 21 years old, and encouraged to illegally gamble.<\/p>\n\n\n\n<p>From the complaint:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>In one instance, Tenney suffered an injury (a deep wound that likely required stitches) which resulted in permanent disfigurement. Faze Clan also encourages underage drinking and gambling in Faze Clan\u2019s so-called Clout House and FaZe House, where Faze Clan talent live and frequently party. It is also widely publicized that Faze Clan has attempted to exploit at least one artist who is a minor.<\/p><\/blockquote>\n\n\n\n<p>Faze Clan issued the following statement on Twitter following the news:<\/p>\n\n\n\n<center><blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">FaZe Clan\u2019s response to today\u2019s press article regarding Tfue: <a href=\"https:\/\/t.co\/eVdRVMnRpl\">pic.twitter.com\/eVdRVMnRpl<\/a><\/p>\u2014 FaZe Clan ? (@FaZeClan) <a href=\"https:\/\/twitter.com\/FaZeClan\/status\/1130567291198791680?ref_src=twsrc%5Etfw\">May 20, 2019<\/a><\/blockquote> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/center>\n\n\n\n<p>Faze Clan claims that it has taken no more than 20%&nbsp;of Tfue\u2019s earnings from sponsored content, which amounts to a total of $60,000. The owner of Faze Clan, Ricky Banks, took to Twitter to make his case, showing the incredible growth of Tfue\u2019s popularity across&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/crunchbase.com\/organization\/twitch\" target=\"_blank\">Twitch&nbsp;<\/a>&nbsp;and YouTube since signing with Faze Clan.<\/p>\n\n\n\n<center><blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">I recruited Tfue to FaZe Clan in April of 2018. These are graphs from both his YouTube &amp; Twitch channels following the mark of our relationship. <a href=\"https:\/\/t.co\/c7m3QwsoTZ\">pic.twitter.com\/c7m3QwsoTZ<\/a><\/p>\u2014 FaZe Banks (@Banks) <a href=\"https:\/\/twitter.com\/Banks\/status\/1130575292416716800?ref_src=twsrc%5Etfw\">May 20, 2019<\/a><\/blockquote> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/center>\n\n\n\n<p>As it stands now, Tfue boasts more than 120 million views on Twitch, more than 10 million YouTube subscribers and 5.5 million followers on Instagram.<\/p>\n\n\n\n<p>Banks also reiterated Faze Clan\u2019s official statement saying that the company has taken 20% of Tfue\u2019s earnings from branded deals, totaling $60,000.<\/p>\n\n\n\n<center><blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">OK LAST TWEET &#8211; To clarify Turners contract does outline splits in prizes, ad revenue, stuff like that. But again we&#8217;ve collected absolutely none of it with no plans to and that was very clear to him. We have collected a total of $60,000 from 300k in brand deals (20%).
