{"id":4753,"date":"2019-08-02T12:32:47","date_gmt":"2019-08-02T19:32:47","guid":{"rendered":"https:\/\/ftllp.net\/?p=4753"},"modified":"2024-11-02T13:30:52","modified_gmt":"2024-11-02T20:30:52","slug":"faze-clan-files-countersuit-against-turner-tfue-tenney-for-breaking-contract-and-appropriating-trade-secrets-and-confidential-information","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/gaming\/faze-clan-files-countersuit-against-turner-tfue-tenney-for-breaking-contract-and-appropriating-trade-secrets-and-confidential-information\/","title":{"rendered":"FaZe Clan Files Countersuit Against Turner \u201cTFue\u201d Tenney For Breaking Contract and Appropriating \u201cTrade Secrets and Confidential Information\u201d"},"content":{"rendered":"\n<p>E-sports organization&nbsp;<em>FazeClan<\/em>&nbsp;has filed a&nbsp;<a href=\"https:\/\/www.scribd.com\/document\/420492276\/Faze-Clan-vs-Turner-Tfue-Tenney#from_embed?campaign=SkimbitLtd&amp;ad_group=66960X1514734Xa7a63140ab6ef5b08635e8aa83d92586&amp;keyword=660149026&amp;source=hp_affiliate&amp;medium=affiliate\" target=\"_blank\" rel=\"noreferrer noopener\">counter lawsuit<\/a>&nbsp;against Turner \u201cTfue\u201d Tenney, alleging that Tenney has brought \u201cnegative attention to FaZe Clan\u201d and is attempting to \u201cstart a new esports organization.\u201d<\/p>\n\n\n\n<p>In&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/boundingintocomics.com\/2019\/05\/21\/pro-gamer-tfue-sues-faze-clan-over-oppressive-contract-believes-company-violated-california-law\/\" target=\"_blank\">the initial lawsuit<\/a>&nbsp;filed by Tenney against&nbsp;<em>FaZe Clan<\/em>, Tenney asserted that the contract he had entered into with&nbsp;<em>FaZe&nbsp;<\/em>was \u201c<a rel=\"noreferrer noopener\" href=\"https:\/\/www.scribd.com\/document\/410833590\/Tenney-v-Faze-Clan\" target=\"_blank\">oppressive<\/a>\u201d, claiming that&nbsp;<em>FaZe Clan&nbsp;<\/em>retained \u201ca grossly unconscionable commission for sourcing [a sponsorship deal] up to eighty percent (80%)\u201d and attempted to \u201cprevent Tenney from procuring or 22 negotiating such employment opportunities without Faze Clan.\u201d<\/p>\n\n\n\n<p>However, in their countersuit,&nbsp;<em>FaZe Clan&nbsp;<\/em>alleges that Tenney violated his contract, which is still legally binding \u201cthrough October 7, 2021,\u201d by \u201cusing FaZe Clan\u2019s trade secrets and confidential information, as described above, to create a competing organization or otherwise compete against FaZe Clan\u201d and \u201ccaused damage to FaZe Clan, including the termination of certain brand sponsorship deals and the forced renegotiation of brand deals on less favorable terms.\u201d The team also stated that they \u201cschooled Tenney in the business, social media and gaming practices that have made FaZe Clan successful,\u201d noting that he has earned \u201c$20 million since&nbsp; joining FaZe Clan in April 2018\u201d thanks to their assistance.<\/p>\n\n\n\n<p><em>FaZe Clan&nbsp;<\/em>is seeking \u201cdamages in the amount according to proof at trial, plus interest at the legal rate,\u201d as well as \u201cpermanent injunctive relief\u201d from Tenney disparaging the company, interfering with their business dealings, and using their trade secrets.<\/p>\n\n\n\n<p>In a statement provided to\u00a0<em><a href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/faze-clan-claims-fortnite-star-tfue-is-using-secrets-launch-a-competitor-1228659?utm_source=twitter&amp;utm_medium=social&amp;utm_source=Direct\">The Hollywood Reporter<\/a>,\u00a0<\/em><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Turner\u2019s attorney Bryan Freedman<\/a> classified\u00a0<em>FaZe Clan<\/em>\u2019s complaint as \u201cridiculous\u201d:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cFaze Clan\u2019s lawsuit in New York is a ridiculous and obvious attempt to avoid the consequences of its clear violations of California law. Filing the lawsuit in New York is actually an admission that Faze Clan has no defense to these violations of California law. Ask yourself, why is Faze Clan is afraid to litigate its wrongful conduct in California? The answer is obvious. Faze Clan will lose. In the New York lawsuit, Faze Clan actually admits to violating California\u2019s Talent Agencies Act by procuring employment without a license. Equally egregious is the fact that Faze Clan is suing Turner under its illegal contract for the monies it publicly represented that it was not collecting.
