The notion of a celebrity persona crafted solely via occasional media appearances seems about as quaint and outdated as a black-and-white movie or a print magazine. What matters now, in many circles, is&nbsp;<em>the conversation<\/em>, the constant churn of a carefully curated digital profile: media hits, social chatter and comments, video clips, and searchable content\u2014both seeded and unseeded\u2014that together comprise an evolving&nbsp;<em>perception<\/em>&nbsp;of a public person.<\/p>\n\n\n\n<p>The old P.R. system obviously had its flaws. But it has been replaced by, essentially, guerrilla warfare\u2014a 24\/7 battle for attention, impressions, and&nbsp;<em>sentiment<\/em>, all of it subject to manipulation and, in moments of crisis or vulnerability, outright implosion. The new, expanded battlefield has also empowered some of the world\u2019s worst people, trained in the dark arts of media machinations and less constrained by the guardrails of traditional journalists and other gatekeepers. They call themselves&nbsp;<em>crisis communications experts<\/em>&nbsp;or&nbsp;<em>reputation management consultants<\/em>, but they are really a subset of those people, political operatives trained to attack, obfuscate, misinform,&nbsp;<em>flood the zone<\/em>, and, if necessary, to destroy for a price.<\/p>\n\n\n\n<p>&nbsp;At the same time, film and television stardom is much more ephemeral, both financially and culturally, than it used to be. The celebrity industrial complex pot of gold can now generally be found at the end of the <em>personal brand<\/em> rainbow, via the <em>leveraging<\/em> of those amorphous qualities: public persona, goodwill, aspiration, and, for some, talent. Commoditization has always been a mostly beneficial byproduct of celebrity, but now the cultivation of a personal brand is what matters above all else. It creates value amid the noise and, when managed particularly well, can turn average celebrities like <strong>Kylie Jenner<\/strong> and <strong>Selena Gomez<\/strong> and <strong>Ryan Reynolds<\/strong> into billionaires.<\/p>\n\n\n\n<p>This is all a long way of explaining why the wars of perception being waged online matter so much. Or why <em>astroturfing<\/em>\u2014flooding the web with content that appears to be organically produced but is actually part of a paid campaign to push an agenda, often to smear someone or fire back against an attempted smearing\u2014is now a service that certain P.R. firms casually offer on their menu, like a side of fries with a Double Double. And it\u2019s why the battle behind the scenes, and now completely engulfing, the summer hit movie <em>It Ends With Us<\/em> has become the saddest, nastiest, and unfortunately most cutting-edge public relations war of 2024.&nbsp;<\/p>\n\n\n\n<p>For these reasons, the publicists leading this fight\u2014mostly the team allegedly smearing star <strong>Blake Lively<\/strong> on behalf of her co-star and producer-director <strong>Justin Baldoni<\/strong>, but also <em>many others<\/em> involved here, both directly and tangentially\u2014are Hollywood\u2019s Villains of the Year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-we-can-bury-anyone\"><br>\u201cWe Can Bury Anyone\u201d<\/h2>\n\n\n\n<p>Have you actually read the <a href=\"https:\/\/email.puck.news\/e\/c\/eyJlbWFpbF9pZCI6ImRnVDJ4Z1lEQUpfN0laNzdJUUdUOTlkYnJjam9NelVfdkpqLVdOND0iLCJocmVmIjoiaHR0cHM6Ly9zdGF0aWMwMS5ueXQuY29tL25ld3NncmFwaGljcy9kb2N1bWVudHRvb2xzLzE2MjljYzM0ZTU2MmUzMjUvNDQxMGIxZDktZnVsbC5wZGY_dXRtX2NhbXBhaWduPVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjMlMkYyNCUyOVx1MDAyNnV0bV9jb250ZW50PVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjQlMkYyNCUyOVx1MDAyNnV0bV9tZWRpdW09ZW1haWxfYWN0aW9uXHUwMDI2dXRtX3NvdXJjZT1jdXN0b21lci5pb1x1MDAyNnV0bV90ZXJtPWY2YzYwNjEyYmU4MDAxOWZmYjIxIiwiaW50ZXJuYWwiOiJmNmM2MDYxMmJlODAwMTlmZmIyMSIsImxpbmtfaWQiOjIwMjU4NjR9\/6f13753de2fccfe151cff58452f4f87da9aa328ddc34bfa2682490c3e15d8d79\">complaint<\/a> in <em>Blake Lively v. Wayfarer Studios LLC et al.<\/em>? Grossness all around. Yes, there are the scheming texts from the Baldoni operatives, including <strong>Melissa Nathan<\/strong>\u2014last seen sliming <strong>Amber Heard<\/strong> out of Hollywood on behalf of <strong>Johnny Depp <\/strong>during their defamation trial\u2014and <strong>Jen Abel<\/strong>, who worked alongside my old buddy <strong>Stephanie Jones<\/strong>, a publicist so vindictive and dishonest that Business Insider recently <a href=\"https:\/\/email.puck.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\">devoted<\/a> 3,500 words to her behavior. The texts seem lifted from a mustache-twirling cartoon nemesis: \u201c<em>We can bury anyone<\/em>\u201d \u2026 \u201c<em>I think we need to put the social combat plan into motion<\/em>\u201d \u2026 \u201c<em>We can\u2019t write we will destroy her.<\/em>\u201d Plus <strong>Jed Wallace<\/strong>! A notorious figure in crisis P.R. who positions himself as a master manipulator of \u201cthe narrative,\u201d all on behalf of a guy, Baldoni, who stands accused of sexual harassment (which his lawyer denies) despite repeatedly calling himself a \u201cfeminist ally\u201d and hosting a podcast where he talks about his activism <em>all the time<\/em>. Can\u2019t make this stuff up.<\/p>\n\n\n\n<p>As enjoyable as it is to see gross texts and awful people <a href=\"https:\/\/email.puck.news\/e\/c\/eyJlbWFpbF9pZCI6ImRnVDJ4Z1lEQUpfN0laNzdJUUdUOTlkYnJjam9NelVfdkpqLVdOND0iLCJocmVmIjoiaHR0cHM6Ly93d3cubnl0aW1lcy5jb20vMjAyNC8xMi8yMS9idXNpbmVzcy9tZWRpYS9ibGFrZS1saXZlbHktanVzdGluLWJhbGRvbmktaXQtZW5kcy13aXRoLXVzLmh0bWw_dXRtX2NhbXBhaWduPVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjMlMkYyNCUyOVx1MDAyNnV0bV9jb250ZW50PVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjQlMkYyNCUyOVx1MDAyNnV0bV9tZWRpdW09ZW1haWxfYWN0aW9uXHUwMDI2dXRtX3NvdXJjZT1jdXN0b21lci5pb1x1MDAyNnV0bV90ZXJtPWY2YzYwNjEyYmU4MDAxOWZmYjIxIiwiaW50ZXJuYWwiOiJmNmM2MDYxMmJlODAwMTlmZmIyMSIsImxpbmtfaWQiOjIwMjU4NjV9\/6a76ba91d9efccb180829ec054214cf8bbb95c11ab58b06890e46134cb208e3f\">exposed<\/a> in <em>The<\/em> <em>New York Times<\/em> and now across the media, their strategies aren\u2019t too shocking given the modern realities of high-stakes P.R. wars. Maybe I\u2019m jaded because I\u2019ve been on the receiving end of these campaigns, but lots of publicists and lawyers are aggressive in a crisis\u2014you get fired these days if you aren\u2019t\u2014and Abel claimed in a Facebook post that the machinations were mostly preparation: \u201cThere was no \u2018smear\u2019 implemented.\u201d&nbsp;<\/p>\n\n\n\n<p>I seriously doubt that\u2026 Case in point: On August 10, the day after <em>It Ends With Us<\/em> came out, Nathan\u2019s team reported that they had \u201cstarted to see [a] shift on social, due largely to Jed and his team\u2019s efforts to shift the narrative.\u201d That sure <em>sounds<\/em> like implementation. But even the <em>Times<\/em> acknowledges it\u2019s \u201cimpossible\u201d to determine whether any of the alleged sliming was actually responsible for that shift in sentiment, or the ultimate damage to Lively\u2019s brands. Sales of those brands <a href=\"https:\/\/email.puck.news\/e\/c\/eyJlbWFpbF9pZCI6ImRnVDJ4Z1lEQUpfN0laNzdJUUdUOTlkYnJjam9NelVfdkpqLVdOND0iLCJocmVmIjoiaHR0cHM6Ly9wdWNrLm5ld3MvYmxha2UtbGl2ZWx5cy1ob3QtaGFpcmNhcmUtbGF1bmNoLWNvbWVzLWJhY2stZG93bi10by1lYXJ0aC8_dXRtX2NhbXBhaWduPVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjMlMkYyNCUyOVx1MDAyNnV0bV9jb250ZW50PVdoYXQrSSUyN20rSGVhcmluZystK1NVQlNDUklCRVJTKyUyODEyJTJGMjQlMkYyNCUyOVx1MDAyNnV0bV9tZWRpdW09ZW1haWxfYWN0aW9uXHUwMDI2dXRtX3NvdXJjZT1jdXN0b21lci5pb1x1MDAyNnV0bV90ZXJtPWY2YzYwNjEyYmU4MDAxOWZmYjIxIiwiaW50ZXJuYWwiOiJmNmM2MDYxMmJlODAwMTlmZmIyMSIsImxpbmtfaWQiOjEwNDg1NjV9\/7be7ccc1d80dd526015800b5a07e446baef4971e4e963c40a744743d1a7155b1\">tanked<\/a> after the Baldoni onslaught is said to have begun, but how much is provably his team\u2019s fault?<\/p>\n\n\n\n<p>What\u2019s most interesting\u2014and, frankly, a little bit gross, if also understandable\u2014is how Lively\u2019s team has chosen to fight back. Her lawyers at Manatt and Willkie Farr &amp; Gallagher filed this matter as a 10-count complaint with California\u2019s Civil Rights Department. It\u2019s not an actual lawsuit, but a first step <em>toward<\/em> a suit. And it encourages the state to investigate on its own, but it also allows for some rare pre-complaint discovery\u2014a similar strategy to the one Willkie is deploying on behalf of <strong>Drake<\/strong> in his ongoing war with Universal Music Group.<\/p>\n\n\n\n<p>That led to the early \u201csubpoena\u201d of these private and highly inflammatory text messages\u2026 not from Abel or Baldoni or anyone at Wayfarer, but from none other than Stephanie Jones, who terminated Abel in late August and, by all accounts, hates her guts. Jones and Abel split shortly after the release of <em>It Ends With Us<\/em> and the publication of that Business Insider story, though Jones continued to rep Wayfarer. Multiple sources told me that Jones confiscated Abel\u2019s work phone as part of that split, which was particularly heated because Abel was leaving to start her own firm. Since then, Jones has been on a crusade against her former colleague\u2014and those who know Jones well have told me she will stop at nothing to harm a perceived enemy. When <strong>Dwayne Johnson<\/strong> split with Jones last year, negative media coverage began appearing about him. At the time, Jones denied she was responsible.)<\/p>\n\n\n\n<p>So, all of a sudden, Jones was \u201csubpoenaed\u201d for Abel\u2019s private communications, which were then leaked to the <em>Times<\/em> for an article that absolutely buried Abel? At the very least, it appears that Jones <em>maybe<\/em> volunteered those texts to harm her nemesis, even if they also hurt Wayfarer, and Lively\u2019s lawyers <em>maybe<\/em> laundered the source via the \u201csubpoena.\u201d (Compliance with the subpoena could also free Jones from confidentiality obligations she had to Abel.)&nbsp;<\/p>\n\n\n\n<p>It also <em>maybe <\/em>seems notable that neither Jones nor her company, Jonesworks, is mentioned <em>a single time<\/em> in either the Lively complaint or the <em>Times<\/em> story, despite being a Wayfarer publicist and Abel\u2019s employer when much of the allegedly nefarious activities went down. The <em>Times<\/em> noted that Nathan\u2019s P.R. firm was backed by <strong>Scooter Braun<\/strong>, but that tidbit would have been even more interesting had the story mentioned that Braun has also been repped by\u2026 you guessed it, Steph Jones. Braun\u2019s passive involvement in a slime campaign against Lively, a B.F.F. of his nemesis <strong>Taylor Swift<\/strong>, herself a master of her own media narrative, adds another incestuous element to this sordid affair. As does the fact that Jones\u2019s husband is <strong>Jason Hodes<\/strong>, an agent at WME, which reps both Lively and her husband, Ryan Reynolds, and which just dropped Baldoni, no doubt under pressure from the Reynolds-Livelys. Keeping up? (Disclosure: WME represents Puck, but not me personally.)&nbsp;&nbsp;<\/p>\n\n\n\n<p>Speaking of WME: Let\u2019s not pretend that the agency, whose parent company continues to employ caught-on-video wife beater <strong>Dana White<\/strong>, cut Baldoni due to anything other than financial considerations. I\u2019ve had several conversations with WME agents this year about how they <em>don\u2019t<\/em> just quickly cancel people. They <em>consider<\/em> accusations carefully and convene a <a href=\"https:\/\/email.puck.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\">\u201cclient action committee\u201d<\/a> of stakeholders before they drop anyone, as they did with <strong>Morgan Wallen<\/strong> in 2021 after his racist comments surfaced.&nbsp;<\/p>\n\n\n\n<p>And yet, no such committee was convened before Baldoni was booted. Why? Optics, yes, and both Sony and SAG-AFTRA have since put out statements supporting Lively. But Lively and Reynolds, a massive WME client, are almost certainly calling the shots. Remember when <strong>J.J. Abrams<\/strong> and his wife, <strong>Katie McGrath<\/strong>, basically demanded that CAA fire agent <strong>Adam Berkowitz<\/strong> after he was accused of inappropriate conduct? Similar vibes here.&nbsp;<\/p>\n\n\n\n<p>Anyway, knowing that this Steph Jones angle would all come out during the litigation, Lively\u2019s lawyers admitted to me today that her company was the source of the texts. \u201cThe subpoena disclosed and referenced in the complaint was served on Jonesworks LLC,\u201d they said in a statement. \u201cThe internal documents referred to in the complaint were produced subject to that subpoena.\u201d They say more information is forthcoming but declined to comment further.<\/p>\n\n\n\n<p>For its part, the <em>Times <\/em>story\u2014whose byline includes <strong>Megan Twohey<\/strong>, of <strong>Harvey Weinstein<\/strong> Pulitzer fame, further elevating the allegations\u2014revealed only that the private communications were \u201csubpoenaed,\u201d neglecting to mention that they were subpoenaed <em>from Jones<\/em>, who has a clear axe to grind in this situation. That\u2019s <em>maybe<\/em> interesting, too.<\/p>\n\n\n\n<p>Adding <em>yet more<\/em> fuel to the fire, <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/lawyers\/bryan-j-freedman\/\"><strong>Bryan Freedman<\/strong>, the litigator for Wayfarer, Baldoni, Nathan, and Abel<\/a>, is now claiming that the complete set of texts from Abel\u2019s phone will show that Lively\u2019s team <em>cherry-picked<\/em> communications that are \u201cdeliberately misleading, altered and are taken completely out of context.\u201d The irony, he said, \u201cwill be that the \u2018smear campaign\u2019 is Lively\u2019s team purposely withholding texts that prove that no smear campaign ever took place.\u201d Hmmm. The texts out there already are <em>pretty bad<\/em>. Regardless, Freedman is now planning to sue Jones, personally. Steph did not respond to my request for comment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-new-p-r-wars\"><br>The New P.R. Wars<\/h2>\n\n\n\n<p>Despite all this, you may still be asking, <em>What\u2019s the big deal?<\/em>\u2014at least legally. After all, social manipulation and astroturfing are just part of the crisis playbook these days. It\u2019s all noise online, right? Baldoni\u2019s team may have supercharged negative sentiment or boosted unflattering interviews of Lively, but they didn\u2019t <em>create<\/em> those interviews out of thin air. That\u2019s why Lively\u2019s complaint includes breach of contract and retaliation claims. Essentially, the aggressive P.R. tactics might not be actionable\u2026 except for the fact that she had accused Baldoni of sexual harassment and his company <em>agreed in writing<\/em> that it wouldn\u2019t attack her in response.<\/p>\n\n\n\n<p>That broad side-letter contract stemmed from Lively\u2019s claims of harassment on-set, after which she got Baldoni and Wayfarer to agree to refrain from 30 separate categories of bad behavior, everything from unwanted touching and dirty talk to \u201cno more adding of sex scenes, oral sex, or on-camera climaxing by Lively outside the scope of the script she approved when signing on to the project.\u201d<\/p>\n\n\n\n<p>That agreement laid the groundwork for her current harassment claim, and it also allowed her to argue a breach of the provision that called for \u201cno retaliation of any kind\u201d against Lively, \u201cincluding during publicity and promotional work.\u201d Even if <em>Lively<\/em> spread dirt on Baldoni (which she maintains she didn\u2019t), she was under no such constraint.&nbsp;<\/p>\n\n\n\n<p><br>A pretty smart strategy, though this case is certainly in the early stages.
