{"id":41292,"date":"2024-10-03T22:15:00","date_gmt":"2024-10-04T05:15:00","guid":{"rendered":"https:\/\/dev.creativespikedigital.com\/lftc\/?p=41292"},"modified":"2025-04-15T16:45:34","modified_gmt":"2025-04-15T23:45:34","slug":"prosecutors-are-reviewing-new-evidence-in-menendez-brothers-1996-murder-conviction","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/criminal\/prosecutors-are-reviewing-new-evidence-in-menendez-brothers-1996-murder-conviction\/","title":{"rendered":"Prosecutors Are Reviewing New Evidence in Menendez Brothers\u2019 1996 Murder Conviction"},"content":{"rendered":"\n<p>LOS ANGELES \u2014 Prosecutors in Los Angeles are reviewing new evidence in the case of Erik and Lyle Menendez to determine whether they should be serving life sentences for killing their parents in their Beverly Hills mansion more than 35 years ago, the city\u2019s district attorney said Thursday.<\/p>\n\n\n\n<p>Los Angeles County District Attorney George Gasc\u00f3n said during a news conference that there is no question Erik Menendez, 53, and his 56-year-old brother, Lyle Menendez, committed the murders, but his office will be reviewing new evidence and will make a decision on whether a resentencing is warranted in the notorious case that captured national attention.<\/p>\n\n\n\n<p>The new evidence presented in a petition includes a letter written by Erik Menendez that his attorneys say corroborates the allegations that he was sexually abused by his father.<\/p>\n\n\n\n<p>The brothers have said they killed their parents out of self-defense after enduring a lifetime of physical, emotional and sexual abuse from them. Their attorneys argue that because of society\u2019s changing views on sexual abuse, that the brothers may not have been convicted of first-degree murder and sentenced to life without parole today.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/lawyers\/bryan-j-freedman\/\">Bryan Freedman<\/a>, the extended family\u2019s lawyers, said they strongly support the brothers\u2019 release.<\/p>\n\n\n\n<p>\u201cShe wishes nothing more than for them to be released,\u201d Freedman said of Joan VanderMolen, the brothers\u2019 aunt.<\/p>\n\n\n\n<p>The brothers\u2019 attorneys said the family believed from the beginning they should have been charged with manslaughter rather than murder. Manslaughter was not an option for the jury during the second trial that ultimately led to the brothers\u2019 murder conviction, attorney Mark Geragos said.<\/p>\n\n\n\n<p>Lyle Menendez, who was then 21, and Erik Menendez, then 18, admitted they fatally shot-gunned their entertainment executive father Jose Menendez and their mother, Kitty Menendez, in 1989 but said they feared their parents were about to kill them to prevent the disclosure of the father\u2019s long-term sexual molestation of Erik.<\/p>\n\n\n\n<p>Prosecutors at the time contended there was no evidence of any molestation. They said the sons were after their parents\u2019 multimillion-dollar estate.<\/p>\n\n\n\n<p>Jurors rejected a death sentence in favor of life without parole.<\/p>\n\n\n\n<p>Attorney Cliff Gardner, who also represents the brothers, said they are pleased by the district attorney\u2019s decision. The attorneys have asked for the court to vacate their conviction.<\/p>\n\n\n\n<p>\u201cGiven today\u2019s very different understanding of how sexual and physical abuse impacts children \u2014 both boys and girls \u2014 and the remarkable new evidence, we think resentencing is the appropriate result,\u201d Gardner said in an email Thursday to The Associated Press. \u201cThe brothers have served more than 30 years in prison. That is enough.\u201d<\/p>\n\n\n\n<p>The case has\u00a0<a href=\"https:\/\/time.com\/7023814\/menendez-brothers-guide-stories\/\">gained new attention<\/a>\u00a0in recent weeks after Netflix began streaming the true-crime drama\u00a0<em>Monsters: The Lyle and Erik Menendez Story<\/em>.<\/p>\n\n\n\n<p>In a statement on X posted by his wife, Erik Menendez called the show a \u201cdishonest portrayal\u201d of what happened that has taken them back to a time when prosecutors \u201cbuilt a narrative on a belief system that males were not sexually abused, and that males experience rape trauma differently from women.\u201d<\/p>\n\n\n\n<p>Gasc\u00f3n said he believes that the topic of sexual assault would have been treated with more sensitivity if the case had happened today.<\/p>\n\n\n\n<p>\u201cWe have not decided on an outcome. We are reviewing information,\u201d Gasc\u00f3n said.<\/p>\n\n\n\n<p>He said his office did not know the \u201cvalidity\u201d of what was presented at the trial.<\/p>\n\n\n\n<p>Gasc\u00f3n, who is seeking reelection, noted that more than 300 people have been resentenced during his term, and only four have gone on to commit a crime again.<\/p>\n\n\n\n<p>A hearing was scheduled for Nov. 29.<\/p>\n\n\n\n<p>Lyle Menendez recently earned a sociology degree from the University of California, Irvine, through a prison program. Geragos said they have been model prisoners despite believing they would never be released.<\/p>\n\n\n\n<p>\u201cI think it\u2019s time,\u201d Geragos said. \u201cThe family thinks it\u2019s time.\u201d<\/p>\n\n\n\n<p>Reality TV star and celebrity personality Kim Kardashian, who has advocated for criminal justice reform, also weighed in, writing in a personal essay shared with NBC News that the outsized media attention on the first trial that was nationally televised denied them justice.<\/p>\n\n\n\n<p>She noted with \u201ctheir suffering and stories of abuse ridiculed in skits on \u2018Saturday Night Live\u2019\u201d that they were painted as \u201ctwo arrogant, rich kids from Beverly Hills who killed their parents out of greed.
