Talk about intersecting plotlines!&nbsp;<\/p>\n\n\n\n<p>Anyway, Miramax, the studio that released \u201cPulp Fiction\u201d in 1994, is having none of it.&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/business\/story\/2021-11-16\/miramax-sues-quentin-tarantino-over-pulp-fiction-nfts\">The company sued the director last week<\/a>, accusing Tarantino of breach of contract, copyright infringement and trademark infringement.<\/p>\n\n\n\n<p>Miramax says Tarantino, who won an Oscar for writing \u201cPulp Fiction\u2019s\u201d screenplay, doesn\u2019t have permission to sell the NFTs under the terms of his 1993 contract with the company and didn\u2019t consult the studio before forging ahead. <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Tarantino\u2019s lawyer Bryan Freedman<\/a> says the filmmaker is allowed to sell the images under his \u201creserved rights.\u201d<\/p>\n\n\n\n<p>As a refresher, NFTs are basically certificates of authenticity that are tracked on a public ledger, giving people a reliable way to prove ownership of one-of-a-kind art, memorabilia and other items. But they\u2019re not the artifacts themselves. An NFT is more like the deed than the house.&nbsp;<\/p>\n\n\n\n<p>Tarantino earlier this month announced plans to sell NFTs containing \u201csecret\u201d content viewable only by the owner, including \u201cthe uncut first handwritten scripts of \u2018Pulp Fiction\u2019 and exclusive custom commentary from Tarantino, revealing secrets about the film and its creator.\u201d<\/p>\n\n\n\n<p>Although the dispute is fascinating, it may not turn out to be a landmark case for copyright and trademark law in the NFT age.&nbsp;<\/p>\n\n\n\n<p>Aaron Moss, an intellectual property attorney at Greenberg Glusker who\u2019s an expert in entertainment cases,&nbsp;<a href=\"https:\/\/copyrightlately.com\/miramax-tarantino-and-a-fight-over-bright-shiny-objects\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote in a blog post<\/a>&nbsp;that this wasn\u2019t really much of a copyright dispute at all and didn\u2019t even have all that much to do with the weird nature of NFTs. It\u2019s more a matter of interpreting Tarantino\u2019s contract.&nbsp;<\/p>\n\n\n\n<p>\u201cNFTs are clearly the bright shiny object that\u2019s driving the parties to court and attracting public interest in the lawsuit,\u201d Moss wrote. \u201cBut the less-shiny reality is that this is primarily a contract dispute \u2014 a fight about whether the publication rights Quentin Tarantino reserved in his agreement with Miramax include the right to sell digital screenplay scans.\u201d<\/p>\n\n\n\n<p>The case will hinge on whether the digital items attached to the NFTs fall under rights Tarantino retained in his deal with the studio, which include the soundtrack album, music publishing, live performance, print publication and interactive media rights. Crucially, the print publication rights in this case include \u201cscreenplay publication,\u201d according to the contract language included with Miramax\u2019s suit.<\/p>\n\n\n\n<p>Under the terms of the contract covering \u201cscreenplay publication,\u201d Tarantino can sell the \u201cPulp Fiction\u201d script in book form or publish a making-of book or novelization, Moss said.&nbsp;<\/p>\n\n\n\n<p>\u201cThe question,\u201d he wrote, \u201cis whether selling \u20181 of 1&#8242; digital scans of pages from the screenplay falls within Tarantino\u2019s publication rights or, conversely, constitutes the sale of something else, such as merchandise, that he assigned to Miramax.\u201d<\/p>\n\n\n\n<p>The dispute is really just a crypto-infused update of an age-old story: studios and artists battling to capitalize on famous work. Tarantino\u2019s plan is another example of artists trying to use this increasingly popular type of asset to make money from existing work and promote themselves to a rabid audience.&nbsp;<\/p>\n\n\n\n<p>But NFTs are a potential revenue stream for studios too, which have taken advantage of the boom by selling commemorative tokens tied to \u201cThe Matrix Resurrections,\u201d \u201cNo Time to Die,\u201d \u201cSpace Jam: A New Legacy\u201d and \u201cGhostbusters: Afterlife.\u201d That\u2019s how NFTs of \u201cMini-Pufts\u201d (or tiny Stay Puft marshmallow men) came into being.&nbsp;<\/p>\n\n\n\n<p>Miramax isn\u2019t the only company asserting rights amid the NFT craze. My colleague Matt Pearce in April wrote about how comic book publishers including DC were&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/story\/2021-04-14\/nfts-intellectual-property-marvel-dc-comics-who-gets-to-make-millions\">clamping down on illustrators<\/a>trying to sell digital superhero artwork as NFTs.&nbsp;<\/p>\n\n\n\n<p>The Tarantino-Miramax could settle, like most entertainment lawsuits. The collectibles are expected to be sold next month, so there\u2019s not much time for Miramax to make its next move, which would be to file a motion for preliminary injunction or apply for a temporary restraining order.&nbsp;<\/p>\n\n\n\n<p>\u201cI have a sneaking suspicion that Tarantino\u2019s folks and Miramax\u2019s folks will figure out a way where everyone can make money, because that\u2019s the easiest path,\u201d said Oklahoma City-based patent attorney T.J. Mantooth, who follows intellectual property cases.<\/p>\n\n\n\n<p>It remains to be seen whether NFTs turn out to be the future of Hollywood collectibles or just another faddish hustle promoted by the financial gurus on TikTok.
