EXCLUSIVE:<\/strong> UPDATE, 11:48 AM: <\/strong>It took almost half a day, but Paradigm Talent Agency<\/a> has finally responded to the more than $2 million lawsuit that Debbee Klein<\/a> launched like a cruise missile late last night at the Sam Gores<\/a>-run company for being unceremoniously axed last month after over two decades in the trenches. <\/p>\n\n\n\n

And Paradigm is being almost as blunt as Klein, almost. <\/p>\n\n\n\n

\u201cWe have seen Ms. Klein\u2019s complaint and it is littered with false, frivolous and scurrilous allegations, which, fortunately for her, are protected by the First Amendment, otherwise she would be facing a defamation suit,\u201d announced Paradigm\u2019s outside counsel Dale Kinsella late this morning after Deadline broke the news of the long time agent\u2019s scathing and sometimes salacious breach of oral contract complaint in the early hours of the morning. \u201cBoth Paradigm and Mr. Gores expect to be 100 percent vindicated, and our intention is to respond further in court filings,\u201d added the often pugilistic Kinsella, Weitzman, Iser, Kump & Aldisert partner.<\/p>\n\n\n\n

So, where ever this goes next, strap in.<\/p>\n\n\n\n

PREVIOUSLY, 12:23 AM<\/strong> Less than two weeks after Sam \nGores dropped the hammer on scores of agents at Paradigm in what were \ntermed temporary layoffs allegedly due to the asphyxiating effect of the\n coronavirus<\/a>\n crisis on the industry, Debbee Klein has hit back with a devastating \nbreach of oral contract lawsuit for \u201cthis reprehensible behavior.\u201d<\/p>\n\n\n\n

Though Gores himself isn\u2019t actually named as a defendant in this initial version of the complaint from the 23-year veteran packaging agent for $2 million and more, the Paradigm chairman is strewn all over the paperwork. Gores is cited in the tales of unrewarded loyalty, repeated claims of \u201chis sexual dalliances with prostitutes\u201d hired with company money, corporate funds used as a \u201cpersonal piggy bank,\u201d a self-sabotaged big bucks deal for Paradigm to be bought by UTA and rampant sexism, among other allegations by one of his long time lieutenants.<\/p>\n\n\n\n

\u201cDespite Mr. Gores recently praising Ms. Klein as the \u2018best agent\u2019 at Paradigm, he rewarded her loyalty and consistent high-performance by terminating her employment via a phone call lasting less than one minute,\u201d the five-claim document filed last night in Los Angeles Superior Court (read it here<\/a>) proclaims. Klein put together black-ish,<\/em> its two spinoffs and much more over the years.<\/p>\n\n\n\n

\u201cThis occurred less than an hour after he sent Ms. Klein a text message stating, \u2018don\u2019t know what\u2019s going to happen, but wanted to say hi and love you,’\u201d the packed compliant from lawyers Bryan Freedman<\/a> and Sean Hardy<\/a> notes of the March 20 axing<\/a>, building a rather forceful narrative.<\/p>\n\n\n\n

Debbee Klein has taken this action not just for her own benefit, but on behalf of all those Paradigm employees in order to ensure that some measure of justice is done and Gores is made to pay for his iniquitous deeds<\/p>\nBryan Freedman of Freedman + Taitelman, LLP<\/cite><\/blockquote>\n\n\n\n

\u201cUnfortunately for Mr. Gores and what remains of his Paradigm agency,\n he forgot that Paradigm had recently entered into a binding oral \nemployment contract with Ms. Klein, under which she could only be \nterminated for good cause,\u201d the Freedman + Taitleman LLP attorneys \ncharge in the 14-page filing for their well-connected client.<\/p>\n\n\n\n

\u201cGiven this simple fact, Paradigm stands in direct breach of its \nemployment contract with Ms. Klein, and now owes Ms. Klein the nearly $2\n million remaining under the term of her contract,\u201d the paperwork states\n of the late 2019 deal worked out between Klein and Paradigm. They claim\n this was a without-paperwork agreement in effect since the start of \n2020, borne out by the former\u2019s altered take-home pay.<\/p>\n\n\n\n

\u201cSam Gores hoped to avoid scrutiny by terminating Ms. Klein in the \nmidst of the present pandemic,\u201d the lawsuit charges, calling it \u201cthe \nperfect opportunity to effectuate his long-planned, ruthless job cuts.\u201d \nAmong the reasons alleged for Klein\u2019s firing after decades of work: \nGores was supposedly enraged by Klein\u2019s expressed concerns over the \nillegality of sex workers being procured and paid through company \naccounts. Even though she had been on Paradigm\u2019s top tier for years, \nKlein says in the lawsuit that she only found out about the sex on the \nexpense accounts scheme in early 2020, from a pink slipped executive \nassistant of the boss.<\/p>\n\n\n\n

Among the many other bombshells is an alleged and ultimately \nunsuccessful strong arming of Klein earlier this year. The plan was to \nhave Klein engage in a conspiracy to pay the agency $500,000 from her \nsalary so Gores \u201ccould show Paradigm\u2019s \u2018bank\u2019 that its income stream was\n consistent with his prior representations.\u201d Didn\u2019t go as planned, the \nsuit makes clear.<\/p>\n\n\n\n

\u201cHis gambit has failed, and Paradigm must now answer for its unlawful\n acts in a court of law,\u201d the filing from the one time partner \nsummarizes.<\/p>\n\n\n\n

Of specific note here \u2014 especially under the looming and tragic \nshadow of the COVID-19 crisis \u2014 Debbee Klein does not appear to have a \nforce majeure clause in her most recent employment contract with \nParadigm. That means that unlike many Paradigm agents cut loose last \nmonth with no severance, and health care that now terminates in June, \nKlein isn\u2019t held to having Paradigm\u2019s obligations to her altered or \nshifted status excused because of unforeseen conditions or circumstances\n beyond either parties\u2019 control.<\/p>\n\n\n\n

Which really means the talent agency that just inked a new franchise agreement with the WGA on March 23<\/a>\n can\u2019t not pay her what they seemingly owe her. And according to the \nsuit, it means Paradigm won\u2019t be able to keep her hanging on for 90 or \nso days without pay and unable to seek new work.<\/p>\n\n\n\n

This could also be far from the last such suit to batter Paradigm in \nthe coming weeks. Along with chatter of a class action being launched, \nnow ex-motion picture lit agent Adam Kanter<\/a> has also retained Freedman + Taitelman, I\u2019ve learned \u2013 with a clear eye to bringing his own action against Gores and Paradigm.<\/p>\n\n\n\n

Klein\u2019s chief attorney tells Deadline this move is ultimately about more than just her.<\/p>\n\n\n\n

\u201cSam Gores\u2019 firing more than two hundred of his company\u2019s most loyal \nemployees while taking away the full benefit of their health insurance \nduring a world health crisis strains credulity,\u201d Bryan Freedman said in a\n statement Thursday. \u201cHowever, taking this knee-jerk action prematurely \nwithout offering to reduce his compensation and while keeping his \nprivate chef and personal driver on the company payroll, is outright \ndespicable,\u201d noted the lawyer also currently representing Gabrielle \nUnion in her on-going dispute with America\u2019s Got Talent<\/em>.<\/p>\n\n\n\n

\u201cDebbee Klein has taken this action not just for her own benefit, but\n on behalf of all those Paradigm employees in order to ensure that some \nmeasure of justice is done and Gores is made to pay for his iniquitous \ndeeds,\u201d Freedman concludes with little to no ambiguity in an already \npretty stark and haunted COVID-19 landscape.<\/p>\n\n\n\n
