{"id":16224,"date":"2020-01-24T17:59:00","date_gmt":"2020-01-25T01:59:00","guid":{"rendered":"https:\/\/dev.creativespikedigital.com\/lftc\/?p=16224"},"modified":"2024-11-01T14:01:27","modified_gmt":"2024-11-01T21:01:27","slug":"the-grammys-vs-deborah-dugan-a-guide-to-the-dueling-messy-accusations","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/the-grammys-vs-deborah-dugan-a-guide-to-the-dueling-messy-accusations\/","title":{"rendered":"The Grammys vs. Deborah Dugan: A guide to the dueling, messy accusations"},"content":{"rendered":"\n<p>In the week leading up to the Grammy Awards, it\u2019s not the&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2019-11-20\/la-et-ms-2020-grammy-nominations-winners-list-2020\" target=\"_blank\" rel=\"noreferrer noopener\">nominated artists<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-23\/grammys-2020-date-time-nominees\" target=\"_blank\" rel=\"noreferrer noopener\">stacked lineup of performers<\/a>&nbsp;who have taken center stage \u2014 but rather the Recording Academy.<\/p>\n\n\n\n<p>The organization, which puts on the Grammys, is embroiled in a bitter battle with its recently ousted president and chief executive, Deborah Dugan.<\/p>\n\n\n\n<p>Damning allegations of sexism, voter corruption, workplace misconduct, sexual assault and more have been thrown in the heated and complicated exchange.<\/p>\n\n\n\n<p>Ahead of Sunday\u2019s ceremony, which airs at 5 p.m. Pacific on CBS, here\u2019s a breakdown of who said what and when, from Dugan\u2019s historic appointment to her&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-23\/grammys-first-female-president-deborah-dugan-ousted-reckoning\" target=\"_blank\" rel=\"noreferrer noopener\">sweeping takedown<\/a>&nbsp;of the organization that appointed her.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aug-1-2019-dugan-takes-control\">Aug. 1, 2019: Dugan takes control<\/h2>\n\n\n\n<p>Dugan became the Recording Academy\u2019s&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment\/music\/la-et-ms-recording-academy-president-deborah-dugan-20190508-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">first-ever female president<\/a>&nbsp;and chief executive \u2014 perceived as a part of a much-needed rebrand after her predecessor, Neil Portnow, infamously suggested at the 2018 Grammys that women&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment\/music\/la-et-ms-grammys2019-nominations-neil-portnow-interview-20181207-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">needed to \u201cstep up\u201d<\/a>&nbsp;if they wanted equal recognition.<\/p>\n\n\n\n<p>Ushered in as a beacon of change, the former chief executive at AIDS nonprofit (RED) told the Los Angeles Times that she intended to build on Portnow\u2019s attempts at diversification and champion underrepresented voices within the industry.<\/p>\n\n\n\n<p>\u201cAll the issues that Neil has addressed have led us to a larger conversation, and that is a conversation, of course, that we need to have about women and diversity in music,\u201d she said shortly after her appointment. \u201cWhere we take it and how we use this organization to effect positive change, that\u2019s one of the questions I\u2019m most excited to answer in this job.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-16-academy-pulls-dugan-amid-misconduct-allegations\">Jan. 16: Academy pulls Dugan amid misconduct allegations<\/h2>\n\n\n\n<p>In a move that sent shock-waves through the music industry, the academy confirmed that Dugan had been relieved of her duties and&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-16\/grammys-deborah-dugan-recording-academy-fired\" target=\"_blank\" rel=\"noreferrer noopener\">placed on \u201cadministrative leave\u201d<\/a>&nbsp;just 10 days before the 2020 Grammys ceremony. The reason? Someone filed a complaint accusing her of misconduct.<\/p>\n\n\n\n<p>Although the organization initially withheld specific details about the nature of the claim, it was said to be leveled in December by \u201ca senior female member of the Recording Academy team,\u201d and a New York Times report categorized it vaguely as \u201cbullying.\u201d<\/p>\n\n\n\n<p>\u201cIn light of concerns raised to the Recording Academy Board of Trustees, including a formal allegation of misconduct by a senior female member of the Recording Academy team, the Board has placed Recording Academy President and CEO Deborah Dugan on administrative leave, effective immediately,\u201d read a statement from the academy provided to the Los Angeles Times.<\/p>\n\n\n\n<p>\u201cThe Board has also retained two independent third-party investigators to conduct independent investigations of the allegations.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-17-complaints-and-threats-abound\">Jan. 17: Complaints and threats abound<\/h2>\n\n\n\n<p>According to the New York Times, Dugan&nbsp;<a href=\"https:\/\/www.nytimes.com\/2020\/01\/16\/arts\/music\/grammys-deborah-dugan-misconduct.html\" target=\"_blank\" rel=\"noreferrer noopener\">filed a complaint<\/a>&nbsp;with the academy\u2019s human resources department a few weeks before her exit that raised concerns about the organization\u2019s practices, which caused her to worry \u201csomething was seriously amiss.\u201d<\/p>\n\n\n\n<p>Among the issues reportedly laid out in Dugan\u2019s message were voting irregularities, financial mismanagement and \u201cexorbitant and unnecessary\u201d legal bills, as well as conflicts of interest involving members of the academy\u2019s board, executive committee and outside lawyers.<\/p>\n\n\n\n<p>After her departure, Dugan issued a threat to the academy via her attorney, quoting Portnow\u2019s controversial 2018 Grammys speech.<\/p>\n\n\n\n<p>\u201cWhat has been reported is not nearly the story that needs to be told,\u201d said crisis litigator Bryan Freedman in the statement. \u201cWhen our ability to speak is not restrained by a 28-page contract and legal threats, we will expose what happens when you \u2018step up\u2019 at the Recording Academy, a public nonprofit.\u201d<\/p>\n\n\n\n<p>Several in the entertainment industry leapt to Dugan\u2019s defense after the scuffle, including former Fox News and \u201cToday\u201d anchor Megyn Kelly and ex-&#8220;America\u2019s Got Talent\u201d judge Gabrielle Union \u2014 both of whom have dealt with highly publicized terminations&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/tv\/story\/2019-12-02\/gabrielle-union-fired-americas-got-talent-nbc\" target=\"_blank\" rel=\"noreferrer noopener\">of their own<\/a>. All three women hired the same lawyer, Freedman, to protect them during their transitions.<\/p>\n\n\n\n<p>\u201cCoulda sworn this is the same board that told women to \u2018step up,\u2019\u201d Union tweeted. \u201cClearly what they really meant was stand down, turn a blind eye to problems, or be fired. #DeborahDugan truly stepped up &amp; tried to make necessary changes &amp; was shown the door. A leaked memo from Mason accused Dugan of offering to retract her initial HR complaint and resign in exchange for a multimillion-dollar contract buyout.<\/p>\n\n\n\n<p>\u201cAfter we received the employee complaints against Ms. Dugan, she then (for the first time) made allegations against the Academy. In response, we started a separate investigation into Ms. Dugan\u2019s allegations,\u201d Mason\u2019s memo read. \u201cMs. Dugan\u2019s attorney then informed the Executive Committee that if Ms. Dugan was paid millions of dollars, she would \u2018withdraw\u2019 her allegations and resign from her role as CEO. &#8230; Following that communication from Ms. Dugan\u2019s attorney, Ms. Dugan was placed on administrative leave as we complete both of these ongoing investigations.\u201d<\/p>\n\n\n\n<p>The Times&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-20\/recording-academy-deborah-dugan-harvey-mason-grammys\" target=\"_blank\" rel=\"noreferrer noopener\">obtained a copy<\/a>&nbsp;on Monday of Mason\u2019s memo to academy members regarding Dugan\u2019s ouster, which also contended that the aforementioned employee complaint against Dugan contained \u201cserious allegations of a \u2018toxic and intolerable\u2019 and \u2018abusive and bullying\u2019 environment created by Ms. Dugan towards the staff.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-21-dugan-accuses-academy-of-sexual-misconduct\">Jan. 21: Dugan accuses academy of sexual misconduct<\/h2>\n\n\n\n<p>Following Mason\u2019s leaked memo, Dugan fired back with some fresh allegations of her own. In a robust 44-page complaint filed with the Equal Employment Opportunity Commission five days before the Grammys, she accused entertainment lawyer Joel Katz&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-21\/grammys-deborah-dugan-recording-academy-sexual-harrassment-neil-portnow\" target=\"_blank\" rel=\"noreferrer noopener\">of sexual harassment<\/a>&nbsp;and claimed that the academy\u2019s board of trustees knew about a previous allegation that Portnow had raped an unidentified \u201cforeign\u201d female performer.<\/p>\n\n\n\n<p>In the complaint, Dugan said she was alerted to the rape allegation against Portnow at a May 2019 board meeting. She also hurled accusations of gender discrimination within the organization, calling its membership a \u201cboys\u2019 club.\u201d<\/p>\n\n\n\n<p>\u201cMs. Dugan was hauled into a conference room and told \u2014 for the very first time \u2014 that a foreign recording artist (and member of the Academy) had accused Mr. Portnow of raping her following a performance that she gave at Carnegie Hall,\u201d the lawsuit read. \u201cThe news was presented to Ms. Dugan as though the Board had just learned of the allegation. &#8230; In reality, they were well aware of the allegation at the time Ms. Dugan agreed to take on the CEO position, but never told her.\u201d<\/p>\n\n\n\n<p>The document went on to claim that&nbsp;Dugan was paid \u201csubstantially less than her two male predecessors\u201d upon her appointment as president and that the sexual assault accusation against Portnow was among \u201cthe real reasons his contract was not renewed.\u201d Additionally, it states that then-Chairman of the Board John Poppo allegedly pressured Dugan to hire Portnow as a consultant for $750,000 after his last contract terminated on July 31, 2019.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-22-portnow-denies-allegations-academy-women-speak-out\">Jan. 22: Portnow denies allegations, academy women speak out<\/h2>\n\n\n\n<p>Portnow vehemently&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-22\/neil-portnow-releases-statement-in-response-to-rape-allegation\" target=\"_blank\" rel=\"noreferrer noopener\">denied the claims<\/a>&nbsp;Dugan waged against him, dismissing them as a \u201cdiversionary tactic.\u201d<\/p>\n\n\n\n<p>\u201cThe allegations of rape are ludicrous, and untrue,\u201d he said in a statement provided to The Times. \u201cThe suggestion that there was is disseminating a lie. The baseless complaint about my conduct referenced in the EEOC filing was immediately brought to the attention of the Board of Directors Executive Committee. An in-depth independent investigation by experienced and highly regarded lawyers was conducted and I was completely exonerated.\u201d<\/p>\n\n\n\n<p>He also added that he never demanded a $750,000 consulting fee and once again addressed the recently reignited backlash to his fateful \u201cstep up\u201d gaffe.<\/p>\n\n\n\n<p>\u201cAfter making the \u2018step up\u2019 comment during the 2018 telecast, for which I have apologized and deeply regret the offense caused, and understanding the power of listening and lessons learned, I took action,\u201d he continued. \u201cI proposed and the Academy created an independent task force to review the state of diversity &amp; inclusion across the organization. After presenting the task force plan and proposed study of the organization to the board, the group was created to implement change.\u201d<\/p>\n\n\n\n<p>Later that day, the four women from the academy board\u2018s eight-member executive committee issued a statement, also provided to The Times, defending the organization against Dugan\u2019s complaint and touting its partnership with the newly implemented Diversity and Inclusion Task Force.<\/p>\n\n\n\n<p>\u201cIt is deeply disturbing to us \u2014 and quite frankly, heartbreaking \u2014 to witness the firestorm against our organization that has been unleashed,\u201d the statement read. \u201cThe Academy is keenly sensitive to any and all allegations of harassment or abuse. &#8230; We have collectively volunteered many years of service guiding and supporting this organization. We would not have taken precious time away from our families and careers if we felt that it was a \u2018boys\u2019 club.\u2019\u201d<\/p>\n\n\n\n<p>And yet another statement followed from the academy\u2019s director of administration, Claudine Little, widely believed to be the \u201csenior female member of the Recording Academy team\u201d who filed the December misconduct complaint against Dugan that started it all.<\/p>\n\n\n\n<p>\u201cMs. Dugan\u2019s choice to litigate in the press and spread a false narrative about the Academy and me and my colleagues is regrettable, but it is also emblematic of Ms. Dugan\u2019s abusive and bullying conduct while she served as the Academy\u2019s President and CEO,\u201d Little said. \u201cIt is disappointing that Ms. Dugan hopes to leverage public opinion along gender lines and expects not to be scrutinized for her inexcusable behavior simply because she is a woman; she should be held to the same standard.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-23-dugan-doubles-down-on-national-tv\">Jan. 23: Dugan doubles down on national TV<\/h2>\n\n\n\n<p>In her first public appearance since filing her EEOC lawsuit, Dugan&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-23\/deborah-dugan-good-morning-america-gma-grammys\" target=\"_blank\" rel=\"noreferrer noopener\">visited \u201cGood Morning America\u201d<\/a>&nbsp;to promote her case against the academy, summarizing many of the grievances aired in the document for a national audience. Elaborating on the \u201cboys\u2019 club\u201d environment, she detailed an alleged encounter with Katz, who previously served as the chair of the academy\u2019s board of trustees.<\/p>\n\n\n\n<p>\u201cAt the very onset \u2014 in fact, under the guise of a work dinner \u2014 I was propositioned by the [Academy\u2019s] general counsel, an entertainment lawyer of enormous, enormous power in the industry,\u201d she said, echoing her complaint. \u201cCalling me \u2018baby\u2019 and saying how attractive I was and pretty I was. \u2026 I felt like I was being tested in how much would I acquiesce. I realized that that was a power-setting move.\u201d<\/p>\n\n\n\n<p>Flanked by lawyer Dougas Wigdor, Dugan also reflected on her brief tenure at the helm of the organization.<\/p>\n\n\n\n<p>\u201cI actually wanted to make change from within,\u201d she said. \u201cI moved across the country. I had a great job. I believe in what the Recording Academy should stand for \u2014 for artists. I was trying at each step to take a deep breath and say, \u2018OK, I can make a difference. I can fix this. I can work with this team.\u2019\u201d<\/p>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe class=\"desktop mobile\" src=\"https:\/\/www.youtube.com\/embed\/rXIp-xMSDy4\" frameborder=\"0\" allow=\"accelerometer; autoplay; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Meanwhile, on \u201cCBS This Morning\u201d \u2014 and later, on&nbsp;<a href=\"https:\/\/youtu.be\/5hWDYRUrYE4\" target=\"_blank\" rel=\"noreferrer noopener\">NBC\u2019s \u201cNightly News\u201d<\/a>&nbsp;\u2014 Dugan and Wigdor expanded on her issues with the academy\u2019s voting system, suggesting that the process was \u201crigged\u201d and favored certain artists over others \u2014 though she didn\u2019t name names.<\/p>\n\n\n\n<p>\u201cIn that room, not only are there trustees that have conflict of interests on particular artists that are nominated, but, more importantly, there are even artists that are nominated that are in the room. So for me, that\u2019s just a blatant conflict of interest,\u201d Dugan said on CBS. \u201cThere\u2019s a system of taking care of their own. I\u2019ll say that it\u2019s mostly white males that are in those rooms that make these decisions.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"jan-23-academys-head-of-awards-and-diversity-task-force-weigh-in-take-sides\">Jan. 23: Academy\u2019s head of awards and diversity task force weigh in take sides<\/h2>\n\n\n\n<p>As Dugan continued to trash the academy\u2019s voting standards in both her complaints and on national TV, the group\u2019s chief awards officer, Bill Freimuth, issued a statement defending the nominations process and calling Dugan\u2019s claims \u201cspurious.\u201d<\/p>\n\n\n\n<p>\u201cIt is the goal of the Recording Academy to ensure the Grammy Awards process is led in a fair and ethical manner and that voting members make their choices based solely on the artistic excellence and technical merits of eligible recordings,\u201d he said in the statement, provided to The Times on Thursday. \u201cSpurious allegations claiming members or committees use our process to push forward nominations for artists they have relationships with are categorically false, misleading and wrong. This process is strictly enforced with everyone involved and has no exceptions.\u201d<\/p>\n\n\n\n<p>Freimuth went on to break down&nbsp;<a href=\"https:\/\/www.grammy.com\/grammys\/awards\/voting-process\" target=\"_blank\" rel=\"noreferrer noopener\">the entire process<\/a>, from the formation of its \u201cdiverse\u201d nomination review committees to circumstantial voting restrictions. Though he conceded, \u201cit is not unusual that some of the [committee members] &#8230; will end up with nominations from the first round\u201d due to industry affiliations, he asserted that \u201cthere are strict rules in place to address any conflict of interest.\u201d<\/p>\n\n\n\n<p>Meanwhile, the academy\u2019s own diversity task force tacitly&nbsp;<a href=\"https:\/\/www.latimes.com\/entertainment-arts\/music\/story\/2020-01-23\/task-force-recording-academy-grammy-week-deborah-dugan\">sided with Dugan<\/a>&nbsp;in a statement also issued Thursday, calling on academy leadership to \u201cimmediately commit themselves to real reform\u201d and actually heed the multiple recommendations made in the task force\u2019s 47-page report aimed at remedying what it found to be systemic lack of inclusion within the academy\u2019s total membership, board of trustees and select committees.<\/p>\n\n\n\n<p>\u201cWe are deeply disappointed at the level of commitment by some of the Academy\u2019s leadership in effecting the kind of real and constructive change presented in our report,\u201d the statement said. \u201cWe are confident that they can do better.\u201d<\/p>\n\n\n\n<p><em>Times staff writer Randy Lewis contributed to this report.<\/em><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the week leading up to the Grammy Awards, it\u2019s not the&nbsp;nominated artists&nbsp;or&nbsp;stacked lineup of performers&nbsp;who have taken center stage \u2014 but rather the Recording Academy.
