Here\u2019s what we know."},"content":{"rendered":"\n<p>Despite a lineup of in-demand performers including Ariana Grande,&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/arts-entertainment\/2019\/08\/27\/how-rosala-brought-flamenco-vmas-into-genre-bending-world-modern-pop\/?tid=lk_inline_manual_2&amp;itid=lk_inline_manual_2\" target=\"_blank\" rel=\"noreferrer noopener\">Rosal\u00eda<\/a>, Lizzo and pop-goth wunderkind Billie Eilish, the coming Grammy Awards will, for the third time in as many years, take place amid turmoil within its ranks.<\/p>\n\n\n\n<p>Last week, the Recording Academy, which puts on the annual ceremony, announced that its chief executive, Deborah Dugan, had been placed on administrative leave after a \u201cformal allegation of misconduct by a senior female member\u201d of the organization. Dugan\u2019s suspension arrived less than six months into her tenure as the academy\u2019s first female chief executive and president \u2014 and just days ahead of the Jan. 26 ceremony.<\/p>\n\n\n\n<p>Dugan responded Tuesday in a stunning 44-page complaint filed with the Equal Employment Opportunity Commission, alleging gender discrimination, sexual harassment and unequal pay on the part of the academy. The complaint, officially known as a charge of discrimination, also claims the organization retaliated against Dugan after she raised concerns \u2014 in an email to a senior human resources executive \u2014 that the academy was operating under a \u201c&#8217;boys\u2019 club\u2019 mentality.\u201d<\/p>\n\n\n\n<p>In her email, Dugan accused Joel Katz, an entertainment lawyer who serves as the academy\u2019s general counsel, of sexually harassing her. The filing also said that allegations of rape by a female artist were \u201cthe real reason\u201d the contract of Dugan\u2019s predecessor, Neil Portnow, was not renewed. Portnow,&nbsp;<a href=\"https:\/\/deadline.com\/2020\/01\/neil-portnow-responds-rape-allegation-recording-academy-1202837900\/\" target=\"_blank\" rel=\"noreferrer noopener\">in a statement<\/a>&nbsp;to media outlets Wednesday, denied the allegations \u201cunequivocally\u201d and called them \u201cludicrous, and untrue.\u201d<\/p>\n\n\n\n<p>Dugan\u2019s lawsuit signals a reckoning for the embattled 63-year-old organization, which has faced mounting criticism in recent years over the Grammys\u2019 failure to properly recognize female artists and artists of color. Here are some answers to questions you might have about the lawsuit \u2014 and how it might affect the Grammys in the future.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-did-the-controversy-start\">When did the controversy start?<\/h3>\n\n\n\n<p>According to Dugan\u2019s lawsuit, she emailed the academy\u2019s director of human resources on Dec. 22, detailing \u201cserious concerns\u201d she had since taking over the organization in August. The email makes a number of claims, ranging from alleged conflicts of interest among the members of the academy\u2019s board of trustees to irregularities in the Grammy voting process.<\/p>\n\n\n\n<p>Dugan also alleged she had been personally sexually harassed by Katz, a former member and chair of the academy\u2019s board of trustees, at a business dinner before her hiring as chief executive. According to Dugan, Katz commented repeatedly on her appearance and attempted to kiss her during the meeting. In her email, Dugan noted that \u201cMr. Katz\u2019s comments about my looks and suggestive remarks have continued unabated since our first meeting.\u201d (As&nbsp;<a href=\"https:\/\/deadline.com\/2020\/01\/recording-academy-joel-katz-denies-sexual-harassment-claim-deborah-dugan-1202837585\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported by Deadline<\/a>, Katz responded through his attorney, who said Katz \u201ccategorically and emphatically denies her version of that evening.\u201d)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-did-the-academy-respond\">How did the academy respond?<\/h3>\n\n\n\n<p>Dugan\u2019s complaint includes an email response from the HR executive, who notes \u201cthese are serious issues that need to be investigated.\u201d Dugan was put on administrative leave just three weeks later \u2014 a decision her legal team says \u201cwas clearly made in retaliation\u201d for raising concerns.<\/p>\n\n\n\n<p>The complaint also takes issue with the statement the academy released recently. Dugan claims board chair Harvey Mason Jr., currently serving as the academy\u2019s interim chief executive, assured her the organization would not offer any statements about the leave, aside from saying, if asked, that Dugan had taken a leave of absence. Instead, the complaint claims, \u201cthe board leaked to the press that Ms. Dugan had been \u2018placed\u2019 on administrative leave.\u201d<\/p>\n\n\n\n<p>Dugan further disputes the academy\u2019s framing of the unspecified allegations of misconduct. Her complaint cast the issue as a dispute involving Portnow\u2019s former executive assistant, and Dugan\u2019s efforts to find the employee a new role after it \u201cbecame clear that\u201d the employee \u201cwas not up to the task\u201d of assisting Dugan. The New York Times, citing \u201ca person with direct knowledge of the events,\u201d said the assistant had accused Dugan of a \u201cbullying management style\u201d that led the assistant to take a leave of absence.<\/p>\n\n\n\n<p>After the academy\u2019s statement last week, a lawyer for Dugan put out a statement alluding to the Grammys\u2019 tumultuous history. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\"><p>What has been reported is not nearly the story that needs to be told. When our ability to speak is not restrained by a 28-page contract and legal threats, we will expose what happens when you \u2018step up\u2019 at the Recording Academy, a public nonprofit.<\/p><cite><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan J. Freedman<\/a> told the paper.<\/cite><\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-s-with-all-the-step-up-references\">What\u2019s with all the \u2018step up\u2019 references?<\/h3>\n\n\n\n<p>The Grammys have been in relative chaos since 2018 when then-president Portnow was asked about the lack of female winners at that year\u2019s ceremony. Portnow&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/news\/arts-and-entertainment\/wp\/2018\/01\/29\/kesha-was-snubbed-at-the-grammys-so-was-sza-the-academys-solution-women-need-to-step-up\/?tid=lk_inline_manual_25&amp;itid=lk_inline_manual_25\" target=\"_blank\" rel=\"noreferrer noopener\">told Variety<\/a>&nbsp;that \u201cwomen who have the creativity in their hearts and souls, who want to be musicians, who want to be engineers, producers, and want to be part of the industry on the executive level\u201d needed to \u201cstep up.\u201d<\/p>\n\n\n\n<p>That didn\u2019t go over well. For one, the nominees for the 2018 ceremony included chart-topping female artists such as Lorde, Lady Gaga and SZA. And Beyonc\u00e9 fans in and around the Beyhive were still smarting after the singer\u2019s transcendent \u201cLemonade\u201d lost (to Adele\u2019s \u201c25\u201d) in the 2017 album of the year category. Portnow\u2019s comments, which he later said were taken out of context, drew condemnation from music fans and artists alike.<\/p>\n\n\n\n<p>\u201cWomen OWNED music this year,\u201d Pink&nbsp;<a href=\"https:\/\/twitter.com\/Pink\/status\/958121509540761600\/photo\/1\" target=\"_blank\" rel=\"noreferrer noopener\">wrote in a letter<\/a>&nbsp;shared to her Twitter account. \u201cAnd every year before this. When we celebrate and honor the talent and accomplishments of women, and how much women STEP UP every year, against all odds, we show the next generation \u2026 what it means to be equal, and what it looks like to be fair.\u201d<\/p>\n\n\n\n<p>Longtime Grammys Executive Producer Ken Ehrlich didn\u2019t exactly help matters when he addressed the seemingly disproportionate stage time the ceremony\u2019s female nominees received at the 2018 ceremony. As&nbsp;<a href=\"http:\/\/variety.com\/2018\/music\/news\/why-isnt-lorde-performing-at-the-grammys-sources-explain-1202679146\/\" target=\"_blank\" rel=\"noreferrer noopener\">Variety reported<\/a>, Lorde, the lone woman up for album of the year, declined to perform after producers asked her to be part of a multi-artist tribute to Tom Petty \u2014 despite the fact the male artists in the category had all been offered solo performance slots.<\/p>\n\n\n\n<p>\u201cThese shows are always a matter of choices,\u201d Ehrlich said, noting that Lorde \u201chad a great album, but there\u2019s no way we can deal with everybody.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-why-does-the-name-ken-ehrlich-sound-familiar\">Why does the name Ken Ehrlich sound familiar?<\/h3>\n\n\n\n<p>Ehrlich was at the center of&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/arts-entertainment\/2019\/02\/09\/grammys-are-latest-casualty-this-tumultuous-award-season\/?tid=lk_inline_manual_35&amp;itid=lk_inline_manual_35\" target=\"_blank\" rel=\"noreferrer noopener\">last year\u2019s Grammys drama<\/a>, which unfolded after Grande tweeted she had pulled out of a planned performance because of a creative disagreement with the ceremony\u2019s producers.<\/p>\n\n\n\n<p>Ehrlich cast Grande\u2019s decision in a different light, telling the Associated Press that by the time the singer and the producers agreed a performance might be possible, Grande \u201cfelt it was too late for her to pull something together for sure.\u201d<\/p>\n\n\n\n<p>Grande refuted that on Twitter, directly addressing Ehrlich: \u201ci can pull together a performance over night and you know that, Ken,\u201d she wrote. \u201cIt was when my creativity &amp; self expression was stifled by you, that i decided not to attend.\u201d<\/p>\n\n\n\n<p>Ehrlich, whose approach to the Grammys had previously been criticized by&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/grammy-producers-respond-to-frank-ocean-criticism-129565\/\" target=\"_blank\">Frank Ocean<\/a>, Drake and Kanye West, later announced he would be&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/grammy-producer-ken-ehrlich-step-down-2020-show-ben-winston-860008\/\" target=\"_blank\">stepping down<\/a>&nbsp;from his role. This year\u2019s ceremony will mark his last as executive producer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-does-dugan-s-complaint-address-the-academy-s-fraught-history-with-the-hip-hop-community\">Does Dugan\u2019s complaint address the academy\u2019s fraught history with the hip-hop community?<\/h3>\n\n\n\n<p>Yes, in addition to highlighting the Grammys\u2019 historic underrepresentation of women, Dugan\u2019s complaint argues that the ceremony\u2019s lack of diversity has repeatedly shut rap and R&amp;B stars such as West, Kendrick Lamar and Beyonc\u00e9 out of the running for album of the year and other major categories.<\/p>\n\n\n\n<p>Critics have long lamented the ceremony\u2019s oversights when it comes to groundbreaking rap artists, but Dugan\u2019s complaint adds disturbing context to the Grammy voting process, outlining a system shrouded \u201cin secrecy\u201d and hampered by a lack of diversity among the academy\u2019s 12,000 voting members. The complaint also asserts that nominations are further skewed by board members who \u201cpush forward artists with whom they have relationships.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-happens-now\">What happens now?<\/h3>\n\n\n\n<p>There\u2019s no indication the dispute between Dugan and the academy will have an impact on the Jan. 26 ceremony. (The&nbsp;<a href=\"https:\/\/twitter.com\/RecordingAcad\" target=\"_blank\" rel=\"noreferrer noopener\">academy\u2019s Twitter account<\/a>&nbsp;continues to tease out the artists performing on \u201cMusic\u2019s Biggest Night.\u201d) But there is little doubt Dugan\u2019s allegations will have implications for the academy\u2019s future, as well as ongoing conversations about gender discrimination and sexual misconduct in the entertainment world.<\/p>\n\n\n\n<p>\u201cThe complaint that we filed today against the National Academy of Recording Arts and Sciences (the Grammys) highlights tactics reminiscent of those deployed by individuals defending Harvey Weinstein,\u201d Dugan\u2019s attorneys said in a statement Tuesday, referring to the disgraced Hollywood producer who is on trial for alleged sexual assault. \u201cAs we allege, the attempt by the Recording Academy to impugn the character of Deborah Dugan is a transparent effort to shift the focus away from its own unlawful activity. This blatant form of retaliation in corporate America is all too common, even post #MeToo, and we will utilize all lawful means necessary to ensure that those responsible are held accountable for their actions.\u201d<\/p>\n\n\n\n<p>Dugan\u2019s complaint could lead to mediation or an investigation by the EEOC, according to&nbsp;<a href=\"https:\/\/www.eeoc.gov\/employees\/process.cfm\" target=\"_blank\" rel=\"noreferrer noopener\">the agency\u2019s website<\/a>. Should the EEOC decline to investigate or if an investigation finds no discrimination, Dugan could file a lawsuit against the academy.<\/p>\n\n\n\n<p>For the academy\u2019s part, Mason assured members \u2014 in an internal memo obtained last week by Rolling Stone \u2014 that operations would \u201cproceed as normal during the interim leadership period\u201d and that the academy\u2019s board \u201cis committed to fostering a safe, diverse and inclusive workplace, music industry and society.\u201d<\/p>\n\n\n\n<p>Mason later&nbsp;<a href=\"https:\/\/www.grammy.com\/grammys\/news\/important-message-harvey-mason-jr-chair-board-and-interim-presidentceo\" target=\"_blank\" rel=\"noreferrer noopener\">addressed Grammy viewers<\/a>&nbsp;in a letter posted to the event\u2019s website. \u201cAs Grammy week is upon us,\u201d he wrote, \u201cI truly hope we can focus our attention on the artists who\u2019ve received nominations and deserve to be celebrated at this time of the year, and not give credence to unsubstantiated attacks on the Academy.\u201d<\/p>\n\n\n\n<p>Dugan said in an appearance Thursday on \u201cGood Morning America&#8221; that she will be watching the ceremony in spite of the drama.
