If broken, it could reportedly cost a fan $1 million plus other legal fees.<\/p>\n\n\n\n<p>A fan named Stacy Young posted an alleged copy of the NDA to Facebook last week, before Davidson\u2019s Nov. 27 show at San Francisco\u2019s Sydney Goldstein Theater. Before tour dates earlier this year, Louis C.K. sent out a copyright notice prohibiting the reproduction of his material.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Louis CK is performing in Minneapolis soon, and the comedy club sent out a notice because he doesn&#8217;t post tour dates anymore. In addition to adding YONDR pouches to his gigs, he also requires them to share this copyright notice that I have never before seen a comedian share\/post.<\/p><p>=====<\/p><p><strong>COPYRIGHT <\/strong><\/p><p><em><strong>Louis CK owns all rights in the content and materials, including any jokes and sketches (the &#8220;Materials&#8221;), delivered during his performance. The Materials may not be copied, translated, transmitted, displayed, distributed, or reproduced verbatim (the&#8221;Use&#8221;), in whole or in part, in any form, media, or technology now known or later developed, without the express prior written consent of Louis CK. Any Use of the Materials without the express prior written consent of Louis CK is strictly prohibited and shall be subject to all available legal remedies, whether in equity or at law at the cost of anyone who violates this prohibition.<\/strong><\/em><\/p><p>====<\/p><cite>James Shotwell (@jamesdshotwell on twitter) May 4, 2019<\/cite><\/blockquote>\n\n\n\n<p>Over the summer, Davidson stopped his set at the University of Central Florida to&nbsp;<a href=\"https:\/\/www.dailydot.com\/upstream\/pete-davidson-phone-rant-central-florida\/\">scold<\/a>&nbsp;audience members for recording it, and allegedly called students \u201cfucking retarded.\u201d So he has reason to be proactive here. Of course, this could just be a scare tactic and not something that will actually be enforced or hold up in court. (And it hasn\u2019t stopped people from making jokes about Davidson or the NDA.)<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/pete-davidsons-stand-up-nda-may-be-effective-deterrent-it-wont-hold-up-court-1259154\" target=\"_blank\"><em>The Hollywood Reporter<\/em><\/a>&nbsp;asked several legal experts about the legality of the NDA, which reportedly wasn\u2019t presented to fans far enough in advance for them to negotiate terms. The consensus seemed to be that while it\u2019s a little too broadly worded to be enforceable, it could be \u201can effective deterrent.\u201d <a href=\"https:\/\/ftllp.net\/attorneys\/bryan-j-freedman\/\">Entertainment litigator Bryan Freedman<\/a> told&nbsp;<em>THR<\/em>&nbsp;that dropping the NDA on fans right before the show could prove more actionable: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\"><p>The customers may end up having a better claim against him and the venue than he would ever have had against them.<\/p><cite>Bryan Freedman<\/cite><\/blockquote>\n\n\n\n<p>Davidson has not commented on the NDA.
