{"id":13129,"date":"2019-11-07T00:00:00","date_gmt":"2019-11-07T08:00:00","guid":{"rendered":"https:\/\/ftllp.net\/?p=13129"},"modified":"2024-11-01T17:57:30","modified_gmt":"2024-11-02T00:57:30","slug":"judge-pauses-arbitration-in-neverland-spat-pending-9th-circuit-review","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/tv_film\/judge-pauses-arbitration-in-neverland-spat-pending-9th-circuit-review\/","title":{"rendered":"Judge Pauses Arbitration in \u2018Neverland\u2019 Spat Pending 9th Circuit Review"},"content":{"rendered":"\n<p>LOS ANGELES (CN) \u2013 A federal judge Thursday&nbsp;<a href=\"http:\/\/www.courthousenews.com\/wp-content\/uploads\/2019\/11\/Optimum.v.HBO_.stay_.motion.10.28.pdf\">granted<\/a>&nbsp;entertainment network HBO\u2019s bid to pause arbitration proceedings with the estate of Michael Jackson over the \u201cLeaving Neverland\u201d documentary pending HBO\u2019s appeal to the Ninth Circuit.<\/p>\n\n\n\n<p>The documentary focuses on the accounts of two men, Wade Robson and James Safechuck, who claim they were sexually abused by Jackson over several years when they were children.<\/p>\n\n\n\n<p>Jackson\u2019s estate sued for $100 million in damages and to force arbitration, saying HBO\u2019s \u201cone-sided\u201d documentary violated a non-disparagement clause from a 1992 agreement between the parties.<\/p>\n\n\n\n<p>The network called the 27-year-old agreement invalid in court papers and moved to dismiss the case under California\u2019s anti-SLAPP statute, which protects against meritless complaints that impede free speech rights.<\/p>\n\n\n\n<p>In a September ruling, U.S. District Judge George Wu denied HBO\u2019s bid to toss the complaint and sent the matter to arbitration.<\/p>\n\n\n\n<p>HBO filed court papers a month later seeking to stay Wu\u2019s order until the Ninth Circuit rules on whether the entertainment network would be \u201cirreparably harmed\u201d by arbitration proceedings.<\/p>\n\n\n\n<p>At issue is whether arbitration in this matter has the effect of chilling HBO\u2019s speech by providing Jackson\u2019s estate with a \u201cperpetual forum\u201d to criticize the documentary, court papers said.<\/p>\n\n\n\n<p>\u201cThe public interest favors a stay given the strong interests in protecting the exercise of First Amendment rights and promoting expressive, newsworthy works exploring issues of public concern such as Leaving Neverland,\u201d attorneys for HBO said in court papers.<\/p>\n\n\n\n<p>At a hearing Thursday in federal court in Los Angeles, Wu granted HBO\u2019s motion for a stay and said he\u2019d like the Ninth Circuit to weigh in on the First Amendment questions.<\/p>\n\n\n\n<p>\u201cThis is not a typical arbitration case,\u201d Wu said, adding later the case is unique because of the First Amendment concerns and that he \u201cisn\u2019t here just to enforce a contract.\u201d<\/p>\n\n\n\n<p>Jonathan Steinsapir of Kinsella Weitzman Iser Kump &amp; Aldisert, an attorney for the Jackson estate, told Wu the stay is simply an HBO delay tactic and that multiple courts have rejected the notion that arbitration equals irreparable harm.<\/p>\n\n\n\n<p>\u201cWe\u2019re not seeing evidence that anyone has been silenced,\u201d Steinsapir said regarding HBO\u2019s free speech concerns. \u201cMichael Jackson is still the most talked about celebrity in the world.\u201d<\/p>\n\n\n\n<p>\u201cTrump may have superseded him, I think,\u201d Wu said, prompting a chorus of chuckles from the gallery.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan Freedman of Freedman &amp; Taitelman<\/a>, an attorney for the plaintiffs, told Wu he is making a simple breach of contract case more complicated than it needs to be.<\/p>\n\n\n\n<p>\u201cWe think it\u2019s a typical contract case.
