A federal judge has issued a tentative ruling to allow the estate to take HBO to arbitration over its docuseries.<\/h2>\n\n\n\n

The Michael Jackson estate has won a temporary victory in its lawsuit<\/a> against HBO over the premium cabler\u2019s Leaving Neverland<\/em> docuseries, in which Wade Robson<\/strong> and James Safechuck<\/strong> detailed alleged abuses they endured by Jackson as children. The Jackson estate, which filed its roughly $100 million lawsuit in February, has argued that in making and distributing Leaving Neverland<\/em> and leaving out its denial of the allegations against Jackson, HBO is in violation of a nondisparagement clause stemming from the network\u2019s 1992 agreement to air a concert film of Jackson\u2019s Dangerous<\/em> tour. HBO claims the pact is now defunct.<\/p>\n\n\n\n

In a tentative ruling Thursday, Judge <\/a>George Wu<\/a><\/strong> denied HBO\u2019s motion to dismiss the case\u2014a decision that the judge is expected to make final by the end of the month. Variety<\/em><\/a> reports that Wu himself suggested HBO file an anti-SLAPP motion, invoking the California law intended to curb litigation aimed at chilling free speech. Now, however, he has determined that the statute does not apply to arbitration requests, Variety<\/em> reports.<\/p>\n\n\n\n

If HBO believes its actions were proper then there is no reason for them to try and hide behind procedural technicalities to avoid an arbitration or a trial.<\/p>Bryan Freedman<\/cite><\/blockquote>\n\n\n\n

The Jackson estate has long slammed<\/a> the docuseries, which debuted soon after Lifetime\u2019s Surviving R. Kelly<\/em> and sparked a similar resurgence of interest<\/a> and passion around the allegations against Jackson. Soon after the doc\u2019s debut, radio stations slowly began<\/a> removing Jackson from their libraries\u2014a sign that perhaps this time, the public is feeling more strongly about the allegations and their merit. (Jackson died in 2009, and denied the allegations during his life; in a 2005 trial, he was acquitted on all charges, including child molestation.) Most recently, the Jackson family decried<\/a> Leaving Neverland<\/em>\u2019s Emmy win, calling the nod a \u201ccomplete farce.\u201d<\/p>\n\n\n\n

In court, Variety<\/em> reports that HBO attorney Theodore Boutrous<\/strong> asked Wu to reconsider denying HBO\u2019s request for dismissal. \u201cIt was filed to chill speech,\u201d Boutrous said of the Jackson estate\u2019s lawsuit. \u201cIt was filed to tell the world, \u2018Don\u2019t talk about child sex abuse.\u2019\u2026A company like HBO may be able to fight back and move forward. Others might not be able to do that.\u201d An HBO representative told Variety,<\/em> \u201cWe are waiting to see the judge\u2019s final decision.\u201d Meanwhile, Bryan J. Freedman,<\/a><\/strong> who represents the Jackson estate<\/a>, slammed HBO in another statement that reads, in part: \u201cHBO has tried everything possible to avoid having a trier of fact adjudicate their wrongdoing.
