{"id":10224,"date":"2014-05-19T00:00:00","date_gmt":"2014-05-19T07:00:00","guid":{"rendered":"https:\/\/ftllp.net\/?p=10224"},"modified":"2024-11-03T17:38:29","modified_gmt":"2024-11-04T01:38:29","slug":"property-owner-may-pull-plug-on-tech-mainstay","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/real-estate\/property-owner-may-pull-plug-on-tech-mainstay\/","title":{"rendered":"Property Owner May Pull Plug on Tech Mainstay"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-real-estate-landlord-says-parties-late-rent-are-grounds-for-eviction\"><strong>REAL ESTATE: Landlord says parties, late rent are grounds for eviction.<\/strong><\/h2>\n\n\n\n<p>Since its opening in Santa Monica two years ago, Real Office Centers has quickly become a fixture in the tech startup scene, boasting the largest co-working space in the city and housing StartEngine, one of the region\u2019s premier accelerators.<\/p>\n\n\n\n<p>But the provider of collaborative workspace is now facing eviction by landlord Hudson Pacific Properties Inc. Brentwood\u2019s Hudson Pacific has sent four eviction notices this year, including two this month, and is fighting in court to repossess the property.<\/p>\n\n\n\n<p>It claims ROC is behind on rent payments and has misused its three-story, 44,000-square-foot facility by throwing parties on the third-floor patio.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\">\n<p>This litigation involves ROC\u2019s refusal to pay rent and its numerous violations of the lease agreement. The evidence is clear that ROC is simply a bad tenant.<\/p>\n<cite>said <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan J. Freedman, an attorney representing Hudson Pacific<\/a>, in an email statement.<\/cite><\/blockquote>\n\n\n\n<p>ROC is pointing the finger the other way, claiming that its rent payments have been rejected and that Hudson Pacific has failed to repair one of the building\u2019s elevators. The Newport Beach company not only wants to keep its prized 604 Arizona Ave. location, but is also seeking more than $1 million in damages in court.<\/p>\n\n\n\n<p>\u201cIt is ROC\u2019s position that all rent has been tendered to Hudson, but Hudson has unilaterally refused to accept it. It is unclear to ROC why Hudson refuses to accept the rent,\u201d the company said in a statement.<\/p>\n\n\n\n<p>News of the eviction fight has surprised and dismayed many in the local tech community, which has come to view ROC\u2019s shared space offering as an important part of the infrastructure. Once occupied by Google Inc. and now a thriving center of activity where dozens of startups and media companies work side by side, the building \u201ckind of symbolizes Silicon Beach,\u201d said StartEngine founder Howard Marks.<\/p>\n\n\n\n<p>Michael Preiss, real estate broker at RSF LA, said that it provided much needed space for emerging companies.<\/p>\n\n\n\n<p>\u201cThat is stunning,\u201d he said. \u201cSanta Monica is the epicenter for startups in L.A. County. It\u2019s really difficult to find space for them. Landlords want Google for 10 years; startups want 1,000 square feet for six months. You take somebody that has more space than all the other co-working spaces combined and close them and evict the tenants, and that\u2019s a problem.\u201d<\/p>\n\n\n\n<p>ROC opened in Santa Monica in late 2012, signing a 10-year lease with Hudson Pacific for the entire building. It claims to have spent millions to upgrade the facility, building it out so that it could accommodate as many as 150 companies at once in its co-working spaces, shared offices and executive suites.<\/p>\n\n\n\n<p>The facility attracted a range of tech and media companies, including Valley Girl Inc. and CliqueMe as well as support businesses. Downtown L.A. law firm Sheppard Mullin Richter &amp; Hampton took a room there in order to provide legal services for startups; StartEngine moved in last year.<\/p>\n\n\n\n<p>According to court documents, ROC agreed to pay a base monthly rent of $152,719, or $3.45 a square foot per month. It also agreed to pay additional costs including maintenance, parking, landscaping, taxes and other expenses.<\/p>\n\n\n\n<p>Hudson Pacific, a major local landlord with a commercial portfolio of 6.2 million square feet, claims ROC fell behind on $436,000 in rent for the period stretching from last June to this February. It also objected to its alleged use of the patio for gatherings, and claimed that ROC was hosting events \u2013 large parties, wedding receptions and pet adoptions \u2013 that were in violation of the lease.<\/p>\n\n\n\n<p>It sued in February in Los Angeles Superior Court, seeking repayment and repossession. The lawsuit is pending.<\/p>\n\n\n\n<p>ROC argues that Hudson Pacific rejected the payments and is using it as an excuse to evict ROC; Hudson Pacific claims the payments were insufficient.<\/p>\n\n\n\n<p>\u201cNonpayment of rent is a pretextual reason used by plaintiff to gain leverage in ongoing negotiations to buy out ROC\u2019s lease,\u201d ROC said in a court filing responding to Hudson Pacific.<\/p>\n\n\n\n<p>ROC filed its own lawsuit against Hudson Pacific this month, saying the eviction was retribution for ROC\u2019s complaints about the status of elevator repairs in the building. Hudson Pacific disputes the claim.<\/p>\n\n\n\n<p>David Toomey, a real estate agent at Cresa Partners, said Hudson Pacific could probably get a better lease rate for the building on the open market today than it did when it signed ROC in 2012. Class A asking rents were $4.48 per square foot in the first quarter of this year, according to Jones Lang LaSalle Inc.<\/p>\n\n\n\n<p>\u201cThe market in Santa Monica has appreciated quite a bit in the last 12 months and so landlords are really starting to push the envelope,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>REAL ESTATE: Landlord says parties, late rent are grounds for eviction.
