In this case it is<a href=\"http:\/\/www.deadline.com\/tag\/uta\/\">&nbsp;UTA<\/a>, that today slammed<em>&nbsp;<a href=\"http:\/\/www.deadline.com\/tag\/unforgettable\/\">Unforgettable<\/a>&nbsp;<\/em>star&nbsp;<a href=\"http:\/\/www.deadline.com\/tag\/poppy-montgomery\/\">Poppy Montgomery<\/a>&nbsp;with a breach of contract complaint in LA Superior Court. The agency wants the more than $248,222 they say they are due in unpaid commissions for the actress\u2019 work on the&nbsp;<a href=\"https:\/\/deadline.com\/tag\/cbs\/\">CBS<\/a>&nbsp;series. In the 16-page jury-demanding filing,&nbsp;<a href=\"https:\/\/deadline.com\/tag\/uta\/\">UTA<\/a>&nbsp;also says it wants general damages, interest and legal fees from Montgomery, who now is with&nbsp;<a href=\"http:\/\/www.deadline.com\/tag\/icm-partners\/\">ICM Partners<\/a>.<\/p>\n\n\n\n<p>\u201cMontgomery paid commissions due to UTA through and including season one of [<em><a href=\"https:\/\/deadline.com\/tag\/unforgettable\/\">Unforgettable<\/a><\/em>], and then, for no reason whatsoever, suddenly stopped making payments,\u201d&nbsp;says the complaint (<a href=\"https:\/\/pmcdeadline2.files.wordpress.com\/2014\/06\/uta-poppy-m-commissions-lawsuit-wm.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">read it here<\/a>). \u201cMontgomery has not only turned her back on the people who helped her career, but on her contractual obligations to those people.\u201d According to filing, UTA and Montgomery entered into an oral agreement in August 2010 that the agency would rep the actress. The&nbsp;<em>Unforgettable<\/em>&nbsp;deal was negotiated in February 2011. The crime drama debuted in September of that year on CBS.&nbsp;Montgomery exited UTA not long after her agent&nbsp;<a href=\"http:\/\/www.deadline.com\/tag\/ruthanne-secunda\/\"><strong>Ruthanne Secunda<\/strong><\/a>&nbsp;joined ICM&nbsp;<a href=\"http:\/\/www.deadline.com\/2012\/12\/icm-partners-hires-uta-talent-agent-ruthanne-secunda\/\">in December 2012<\/a>.&nbsp;<strong>(UPDATE, 8:05 PM:<\/strong>&nbsp;A statement I received from Montgomery\u2019s reps says in part that \u201cPoppy categorically disputes UTA\u2019s claim, which is nothing more than an over-reaching claim by a talent agency which has done nothing for Poppy over the past several years.\u201d<strong>)<\/strong><\/p>\n\n\n\n<p>As is typical in these oh-so-typical cases, the plaintiff makes very clear exactly the 10% of what it wants. In this case, UTA reveals how its former client got $90,000 an episode for Season 1 of&nbsp;<em>Unforgettable,<\/em>&nbsp;with $93,600 per episode for Season 2 and $97,340 for Season 3. It is the money from Seasons 2 and 3 that UTA is looking to be awarded in the 7-claim complaint. In some ways, UTA\u2019s timing with this lawsuit couldn\u2019t have been better as&nbsp;<em>Unforgettable<\/em>&nbsp;is set&nbsp;<a href=\"http:\/\/www.deadline.com\/2014\/05\/summer-tv-schedule-premieres\/\">return for a third season on June 29<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">UTA is represented by Bryan Freedman<\/a> and Jordan Susman of LA firm Freedman + Taitelman.
