Note (02\/11\/2015): This story has been updated with Freeplay&#8217;s response.<\/em><\/p>\n\n\n\n<p>Machinima and Collective Digital Studio have filed separate suits in federal court against online music library Freeplay, claiming the New York company engages in a \u201cbait and switch\u201d copyright scheme to extort money from multichannel networks and their talent.<br><\/p>\n\n\n\n<p>The complaints, filed Monday in the U.S. District Court for the Central District of California, calls Freeplay a \u201cCopyright Troll\u201d that promises free music to video creators but then demands \u201coutrageous\u201d license fees from their multichannel networks for using the content. Machinima and Collective Digital Studio never subscribed to Freeplay\u2019s service, downloaded its music or agreed to its terms and conditions, according to the suits.<\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Bryan J. Freedman, an attorney representing Machinima and Collective Digital Studio<\/a> in their individual filings, said Freeplay\u2019s \u201cdeceptive practices,\u201d which includes what he calls a misleading name, demonstrated the music company did not care about preserving its copyrighted content.<\/p>\n\n\n\n<p>\u201cFreeplay purposely does not issue takedown demands and won\u2019t tell you where the alleged infringing content is because they would rather try to leverage an extortionist settlement,\u201d he said.<\/p>\n\n\n\n<p>Freeplay is led by Scott Schreer, a successful TV song producer and composer whose credits include penning Fox\u2019s NFL theme song. Schreer is also chief executive of VC-backed TuneSat, which monitors satellite TV and the Internet to help clients discover when their music is being played and whether it is being used without a license.<\/p>\n\n\n\n<p>Freeplay\u2019s website says personal use of its music on YouTube is free for a duration of 99 years. But those who use Freeplay\u2019s music for business purposes \u2013 which could include branded and ad-supported videos \u2013 would be required to pay $250 to use one track on one video for a year.<\/p>\n\n\n\n<p><a href=\"http:\/\/www.freeplaymusic.com\/termsandconditions.aspx\"><strong>Freeplay\u2019s terms of use<\/strong><\/a>, updated in October, says, in part, \u201ca free personal YouTube use DOES NOT include Multi-Channel Network managed channel uses.\u201d<\/p>\n\n\n\n<p>That line did not appear in&nbsp;<strong><a href=\"http:\/\/web.archive.org\/web\/20140722090415\/http:\/\/www.freeplaymusic.com\/termsandconditions.aspx\">Freeplay\u2019s usage agreement as of July 22<\/a><\/strong>, according to Internet digital archive Wayback Machine.<\/p>\n\n\n\n<p>A Freeplay representative offered the following statement: &#8220;Freeplay has received the complaints and we are preparing a response that will clearly demonstrate that the allegations and characterizations in the complaints are baseless.
