{"id":10182,"date":"2015-02-26T16:03:00","date_gmt":"2015-02-27T00:03:00","guid":{"rendered":"https:\/\/ftllp.net\/?p=10182"},"modified":"2024-11-03T16:34:36","modified_gmt":"2024-11-04T00:34:36","slug":"courtney-love-fails-to-thwart-defamation-lawsuit","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/fashion\/courtney-love-fails-to-thwart-defamation-lawsuit\/","title":{"rendered":"Courtney Love Fails to Thwart Defamation Lawsuit"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">The singer doesn\u2019t have the following of Marlon Brando, says the judge, calling her claim \u201cself-serving and factually shallow\u201d<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.thewrap.com\/tag\/courtney_love\/\">Courtney Love<\/a>\u2018s attempts to dismiss her defamation lawsuit were thwarted on Thursday, when an appellate judge ruled the entertainer could indeed be sued, as she was less popular than&nbsp;<a href=\"https:\/\/www.thewrap.com\/tag\/marlon_brando\/\">Marlon Brando<\/a>&nbsp;and her case lacked&nbsp;First Amendment implications.<\/p>\n\n\n\n<p>Dawn Simorangkir, the plaintiff in the lawsuit, is a fashion designer who goes by the nickname \u201cBoudoir Queen,\u201d and this is the second lawsuit she has levied against Love.<\/p>\n\n\n\n<p>Simorangkir successfully sued the former Hole frontwoman&nbsp;for Twitter-based (a.k.a. \u201cTwibel\u201d) defamation&nbsp;in 2011&nbsp;to the tune of $430,000, after the singer had called her a prostitute and drug pusher on the popular social media platform. The&nbsp;new case stems from comments&nbsp;Love made in 2014 on Pintrest and during an interview on&nbsp;\u201cThe Howard Stern Show.\u201d<\/p>\n\n\n\n<p>The singer and recurring star of Fox\u2019s&nbsp;<a href=\"https:\/\/www.thewrap.com\/tag\/empire\/\">\u201cEmpire\u201d<\/a>&nbsp;filed an Anti-SLAPP motion \u2014 based around a&nbsp;California law protecting the petition and free speech rights of the state\u2019s residents \u2014 hoping to have the new lawsuit dismissed.&nbsp;But on Thursday the Court of Appeal of the State of California ruled that Love wasn\u2019t actually covered under that statute.<br><\/p>\n\n\n\n<p>In 2004,&nbsp;<a href=\"https:\/\/www.thewrap.com\/tag\/marlon_brando\/\">Marlon Brando<\/a>\u2018s housekeeper, Blanche Hall, sued producers of a TV show examining the actor\u2019s will, which named her as a beneficiary. The court eventually ruled against her, deciding that the TV producers were protected by free speech as Brando\u2019s probate was in fact an issue of widespread public interest.<\/p>\n\n\n\n<p>Judge Allan Goodman cited the Brando case in Thursday\u2019s rulilng, but ultimately decided Love did not fit the bill.<\/p>\n\n\n\n<p>\u201cNothing in the record in this case suggests that defendant has the public interest or following that Brando had; the only evidence in the record is her self-serving and factually shallow claim, coupled with a profession of celebrity by one of her lawyers. Nor is there is any socially important implication in this case akin to that presented by Brando\u2019s gift to his housekeeper to the exclusion of his heirs at law,\u201d Judge Goodman&nbsp;wrote.<br><\/p>\n\n\n\n<p>Love\u2019s legal team argued that her comments should be protected from litigation because they somehow enrich the conversation surrounding freedom of expression, but the judge was unconvinced.<\/p>\n\n\n\n<p>\u201cDefendant in this case contends that her comments on the \u2018Howard Stern Show\u2019 and on the internet have a relationship to the public interest in that they foster debate about the scope of freedom of expression on the internet and in other public fora,\u201d he continued. \u201cYet, defendant presented no admissible evidence that any such debate followed either her appearance on the Howard Stern show or after her Internet postings.\u201d<br><\/p>\n\n\n\n<p><a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Simorangkir\u2019s attorney\u00a0Bryan Freedman<\/a> told\u00a0<a href=\"https:\/\/www.thewrap.com\/\">TheWrap<\/a>\u00a0he was\u00a0pleased\u00a0with the outcome: \u201cOur client is thrilled that the court of appeal ruled in her favor and looks forward to going to trial and proceeding onward against Ms. Love.\u00a0<a href=\"https:\/\/www.thewrap.com\/tag\/courtney_love\/\">Courtney Love<\/a>\u2018s conduct has become an annuity for our client and our firm. We are thrilled at the court\u2019s ruling.\u201d<\/p>\n\n\n\n<p>Love\u2019s attorney, meanwhile, stressed the dismissal of the anti-SLAPP motion has no affect on any potential liability.<\/p>\n\n\n\n<p>\u201cThe appellate court\u2019s ruling is in no way a determination of liability on the underlying defamation claims. In cases such as this that deal with first amendment issues, it is&nbsp;<a href=\"https:\/\/www.thewrap.com\/tag\/common\/\">common<\/a>&nbsp;to file anti-SLAPP motions at the outset. The real case has not even begun yet, and Ms. Cobain looks forward to the opportunity to defend herself before a fair and impartial jury, as she has successfully done on prior occasions,\u201d&nbsp;Richard Dongell, of Dongell Lawrence Finney LLP, said.<br><\/p>\n\n\n\n<p>Previously, Love&nbsp;was sued for Twitter-based libel after tweeting out comments at her former attorney Rhonda Holmes, which the lawyer&nbsp;said damaged her reputation.
