{"id":10162,"date":"2015-05-20T16:32:00","date_gmt":"2015-05-20T23:32:00","guid":{"rendered":"https:\/\/ftllp.net\/?p=10162"},"modified":"2024-11-03T16:07:04","modified_gmt":"2024-11-04T00:07:04","slug":"uta-hits-back-at-caa-over-agent-poaching-lawsuits","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/uta-hits-back-at-caa-over-agent-poaching-lawsuits\/","title":{"rendered":"UTA Hits Back At CAA Over Agent Poaching Lawsuits"},"content":{"rendered":"\n<p>Over a month and a half after&nbsp;<a href=\"https:\/\/deadline.com\/tag\/caa\/\">CAA<\/a>&nbsp;went after&nbsp;<a href=\"https:\/\/deadline.com\/tag\/uta\/\">UTA<\/a>&nbsp;in the courts for what it called \u201ca lawless, midnight raid\u201d of several of the former\u2019s agents&nbsp;<a href=\"https:\/\/deadline.com\/2015\/03\/uta-lands-5-major-caa-comedy-agents-in-mass-exodus-1201402010\/\">on March 31<\/a>, the latter has struck back. \u201cCAA\u2019s Complaint is nothing more than a thinly-veiled attempt to illegally restrict competition through the court system and stands in direct contravention of California\u2019s strong public policy favoring free and open competition, and employee mobility,\u201d bluntly says a filing by UTA in LA Superior Court today (<a href=\"https:\/\/pmcdeadline2.files.wordpress.com\/2015\/05\/uta-caa-cavics-mcknights-demurrer.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">read it here<\/a>). \u201cDespite what CAA would like to believe, its front doors are not a one-way turnstile.\u201d Also calling CAA\u2019s legal reaction over the departing comedy agents \u201ca flailing and desperate attempt to save face,\u201d UTA has asked for a hearings on December 11 and December 18 on the motion to strike and various demurrers that it filed Wednesday in this far far from over legal battle over their newly minted partners.<\/p>\n\n\n\n<p>If that wasn\u2019t clear enough that the Jeremy Zimmer run agency wants to slap away CAA\u2019s April 2 legal action over the surprise snatching of Gregory McKnight, Greg Cavic\u00a0plus Jason Heyman, Martin Lesak, Nick Nuciforo and others, the rest of one of the filings goes straight for the heart of the matter and evoking California\u2019s 7-Year Rule, which prohibits any personal contract lasting longer than that time span. \u00a0\u201cIn its Complaint, CAA alleges that Defendants Gregory Cavic and Gregory McKnight (collectively, \u201cDefendants\u201d) interfered with, and conspired to interfere with, the employment contracts of agents Martin Lesak and Jason Heyman.,\u201d says the notice of demurrer filed by <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">attorneys Bryan Freedman<\/a>, <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/brian-elliot-turnauer\/\">Brian Turnauer<\/a> and <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/sean-m-hardy\/\">Sean Hardy<\/a> today. \u201cAs CAA is well aware, those employment contracts have collectively long exceeded the seven-year rule. \u201c<\/p>\n\n\n\n<p>\u201cHeyman and Lesak\u2019s contracts are therefore unenforceable, rendering CAA\u2019s causes of action for interference with those contracts legally unsustainable,\u201d notes the 13-page motion filing. \u201cWith no way around this fatal flaw, CAA instead deliberately misleads the Court by alleging that Lesak and Heyman began their employment with CAA in 2009. CAA entirely suppresses the fact that it first entered into a written employment agreement with both Lesak and Heyman on July 8, 2005.\u201d The filing then adds as a kicker \u2013 \u201cThis omission was no honest mistake or simple oversight.\u201d<\/p>\n\n\n\n<p>Seeking to turn the bruised CAA\u2019s own words against them, one of UTA\u2019s filings notes that in its demand for Arbitration in the case of comedy agents Lesak and Heyman, the former itself \u201cconcededing\u201d that the duo were hired a decade ago. \u201cThis transparent attempt to deceive the Court violates the truthful pleading and sham pleading doctrines,\u201d said UTA\u2019s lawyers, clearly trying to put CAA on the defensive with the courts. And they also bring up some history between the two agencies over the two agents from a decade ago too. \u201cIn 2005, CAA poached Heyman and Lesak from UTA and induced them to join CAA,\u201d they note. \u201cCAA even went so far as to indemnify Heyman and Lesak in 2005 for their breach of the UTA agreements and for their anticipated solicitation of UTA\u2019s clients. In other words, CAA induced these very agents to terminate their employment with UTA in 2005, yet now allege that UTA\u2019s hiring back of those agents is somehow actionable.\u201d<\/p>\n\n\n\n<p>As all these legal knives have been being sharpened on both sides, other CAA agents have whip a little bit east to UTA &nbsp;and big name clients, such as&nbsp;<a href=\"https:\/\/deadline.com\/tag\/chris-pratt\/\">Chris Pratt<\/a>,&nbsp;<a href=\"https:\/\/deadline.com\/tag\/will-ferrell\/\">Will Ferrell<\/a>&nbsp;(who had followed Lesak and Heyman from UTA to CAA back in 2005) and&nbsp;<a href=\"https:\/\/deadline.com\/tag\/zach-galifianakis\/\">Zach Galifianakis<\/a>&nbsp;have shifted to be with their reps at their new home.
