{"id":10045,"date":"2017-05-22T10:47:00","date_gmt":"2017-05-22T17:47:00","guid":{"rendered":"https:\/\/ftllp.net\/?p=10045"},"modified":"2024-11-03T11:08:52","modified_gmt":"2024-11-03T19:08:52","slug":"vin-diesel-escapes-xxx-sequel-sham-case-from-ex-biz-partner","status":"publish","type":"post","link":"https:\/\/dev.creativespikedigital.com\/lftc\/news\/entertainment\/tv_film\/vin-diesel-escapes-xxx-sequel-sham-case-from-ex-biz-partner\/","title":{"rendered":"Vin Diesel Escapes \u2018xXx\u2019 Sequel \u201cSham\u201d Case From Ex-Biz Partner"},"content":{"rendered":"\n<p>Just over a year after&nbsp;<a href=\"https:\/\/deadline.com\/tag\/vin-diesel\/\">Vin Diesel<\/a>&nbsp;was dragged into court by the former chief of his production company over cash and credits on&nbsp;<em><a href=\"https:\/\/deadline.com\/tag\/xxx-return-of-xander-cage\/\">xXX: Return of Xander Cage<\/a><\/em>&nbsp;and other films, a judge has allowed&nbsp;<em>The Fast and the Furious<\/em>&nbsp;franchise star to drive off the murky case.<\/p>\n\n\n\n<p>In a downtown hearing this morning in Los Angeles Superior Court, Judge John Doyle shut down the third amended complaint from George Zakk, effectively ending the matter that started last May. Having been knocked back or down before by the courts in his pursuit of claims of a verbal deal between him and Diesel of up to $275,000 and a executive producer\u2019s credit on pics that he helped develop while running the star\u2019s One Race Films company, the latest filing of March 17 was the plaintiff\u2019s last chance to get on the track \u2013 and it didn\u2019t get much beyond the starting line.<\/p>\n\n\n\n<p>\u201cBecause Plaintiff\u2019s new allegations were designed, apparently, for no other reason than to avoid the reach of the statute of frauds and a demurrer without leave to amend, the Court finds that the TAC\u2019s new allegations are a sham,\u201d the Judge wrote in a fairly terse tentative ruling issued on May 19 (<a href=\"https:\/\/pmcdeadline2.files.wordpress.com\/2017\/05\/vin-diesel-tentative-lasc.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">read it here<\/a>), that he said Monday he was sticking with. \u201cAccordingly, this basis standing alone is sufficient to sustain the demurrer or strike the TAC,\u201d Judge Doyle added. This morning\u2019s proceedings saw oral arguments from both sides before the judge on the tentative. A proposed judgement will be submitted by Diesel\u2019s attorneys later this week.<\/p>\n\n\n\n<p>\u201cFinally, as alleged in the TAC itself by Plaintiff, the terms of the writing were simply negotiations, and, therefore, cannot constitute evidence of a contract that actually existed,\u201d he also said of the supposed agreement that would have had to occur before Zakk exited Diesel\u2019s production company in 2007. Limitations on such agreements as Zakk alleged, by the way, are one year in the state of California \u2013 so the plaintiff always had a pretty steep road to climb with his One Road claims.<\/p>\n\n\n\n<p>A road that has come to an end \u2013 at least with this round of complaints by Zakk.<\/p>\n\n\n\n<p>\u201cAs the Plaintiff has unsuccessfully amended the complaint three times in this action, and because the defects in the TAC do not appear to be curable, the Court declines to grant leave to amend,\u201d the judge declared in his tentative ruling of last Friday of the action against Diesel, One Road and Revolution Studios.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\">\n<p>We are pleased that the court saw through plaintiff\u2019s attempts to create new stories as the case went on. Today\u2019s ruling that this was a sham complaint should now put a permanent end to the legal circus created by mr. Zakk\u2019s selective memory.<\/p>\n<cite>said <a href=\"https:\/\/dev.creativespikedigital.com\/lftc\/attorneys\/bryan-j-freedman\/\">Diesel\u2019s main lawyer Bryan Freedman<\/a> today after the hearing.<\/cite><\/blockquote>\n\n\n\n<p>A follow up to the original 2002 film,<em>&nbsp;xXx: Return of Xander Cage<\/em>&nbsp;came out on January 20, starting a year that has seen Diesel in blockbusters like the $1.2 billion global grossing&nbsp;<em>The Fate of the Furious<\/em>&nbsp;and&nbsp;<em>Guardians of the Galaxy Vol. 2<\/em>, where he voices the charming resurging Baby Groot with his repeated dialogue of \u201cI am Groot.\u201d Of this year\u2019s Diesel efforts, only the latter&nbsp;<em>Guardians<\/em>&nbsp;pic wasn\u2019t produced by One Films.<\/p>\n\n\n\n<p>Martin Barab, A.
